NIE AS COAPPLICANT

IN HOME LOAN

HOUSING DEVELOPMENT FINANCE CORPORATION LIMITED


WHAT IS NIE?

• “Non Individual Entity” means:


• (a) a Hindu undivided family,
• (b) a company,
• (c) a firm (Partnership firm & Limited Liability firm i.e LLP),
• (d) an association of persons or a body of individuals, whether incorporated or not,
• (e) every artificial juridical person, not falling within any one of the above persons (a to e),
and
• (f) any agency, office or branch owned or controlled by any of the above persons (a to f);
WHY IS NIE ADDED IN LOAN?

• (a) Individual needs a housing loan. For tax and other reasons, he wants the
property in name of a NIE.
• (b)Individual needs an Equity loan for his business which is being run by a NIE.
Security offered in individual’s house. For tax reasons, he wants company to
repay the loan and wants company as coapplicant in loan
• (c) Individual wants to purchase a commercial property for his business in name
of his firm and wants to register property in name of firm.

• It is mandatory from Oct’18, in all the cases where a business entity is sole
proprietorship concern , we should make the concern as coapplicant in loan.
DOCUMENTS REQUIRED TO ADD NIE IN
LOAN AT THE TIME OF LOGIN

• (a) Addendum of firm duly sealed and signed by proprietor/partner/beneficial owner.


• (b) KYC documents of NIE duly sealed and signed.
PRIMARY DOCUMENTS - IDENTITY & ADDRESS -
COMPANIES
Description of primary document that can be accepted for establishing the name, address, telephone/fax of
COMPANIES.
• 1.Certified true copy of the certificate of incorporation and Memorandum & Articles of Association; and
• 2.A resolution passed by the Board of Directors authorizing its personnel to enter into transactions/ agreements and
to open and operate bank accounts on its behalf, their names and specimen signature(s) or
• 3 .The Power of Attorney granted in favor of its personnel to enter into transactions/ agreements and to open and
operate bank accounts on its behalf, their names and specimen signature(s), and
• 4.Permanent Account Number (PAN) of the Company and
• 5.Certified true copy of the latest telephone bill or electricity bill or bank account statement (only in case of newly
incorporated companies) or rent receipt or agreement or letter from the Registered Society evidencing location of its
office premises, subject to the satisfaction of HDFC, or the e- Form 18 filed with the Ministry of Corporate Affairs and
the corresponding Receipt / Challan indicating the successful filing of the said e-Form 18 and
• 6.Certified true copy of any officially valid document* identifying the directors, employees and persons holding the
Power of Attorney and along with their recent Photograph and their addresses and PAN Card or Form 60, subject to
the satisfaction of HDFC.
• *‘Officially valid document ’has been defined to mean and includet he passport ,the driving license, the Voter’s
Identity Card issued by the Election Commission of India ,Job cardi ssued by NREGA duly signed by anofficer of the
State Government, proof of possession of Aadhaar Number and Letter issued by the National Population Register
containing details of name, address or any other document of those individuals who are authorized to actf or and on
behalf of any of the entities stated above as notified by the Central Government in consultation with the Reserve
Bank of India or as may be required by theCorporation.
• Note: KYC of the Beneficial Owner duly identified needs to be obtained and complied with KYC norms to the
satisfaction of HDFC

ADDRESS - PROPRIETORY CONCERN

Description of document that can be accepted for establishing the name or address of a
Proprietory Concern.
• 1 Registration Certificate
• 2 Certified True Copy of Permanent Account Number (PAN) of Proprietor /PAN Allotment Letter and
• 3 Certificate/License issued by Municipal Authorities under Shops and Establishment Act or
• 4 Sales and income tax returns in name of proprietary concern / proprietor where the firm's income is
reflected, or
• 5 GST Certificate bearing address of the proprietory concern or
• 6 License issued by any registering authority / professional body incorporated under a statute like,
certificate of practice issued by Institute of Chartered Accountants of India, Institute of Company
Secretaries of India, Indian Medical Council, Food and Drug Control Authorities, bearing address of the
proprietary concern or
• 7 Importer Exporter Code (IEC) issued by the Director General of Foreign Trade bearing address of the
proprietory concern or
• 8 Certified true copy of the latest telephone bill or water / electricity bill or bank account statement or
rent receipt or agreement or letter from the Registered Society evidencing location of proprietory
concern, subject to the satisfaction of HDFC.

CUSTOMER IDENTIFICATION & ACCEPTANCE - NON-INDIVIDUAL CUSTOMERS - Clause (a) - Part


B of KYC & AML PolicDescription of primary document that can be accepted for establishing
the legal name of a HINDU UNDIVIDED FAMILY.
• 1 Permanent Account Number (PAN) of HUF; and
• 2 Deed of declaration of HUF/ List of coparceners or their agents and their specimen
signatures along with photographs; and
• 3 Latest Bank pass-book / bank statement in the name of HUF.
• * ‘Officially valid document’ has been defined to mean and include the passport, the driving
license, , the Voter’s Identity Card issued by the Election Commission of India, Job card issued
by NREGA duly signed by an officer of the State Government , proof of possession of Aadhaar
Number and Letter issued by the National Population Register containing details of name,
address. or any other document of those individuals who are authorized to act for and on
behalf of any of the entities stated above as notified by the Central Government in
consultation with the Reserve Bank of India or as may be required by the Corporation.

PARTNERSHIP FIRMS
Description of document that can be accepted for establishing the name or address of
PARTNERSHIP FIRMS.
• 1 Certified true copy of the Registration Certificate (if registered) and
• 2 Certified true copy of the Partnership deed and
• 3 Permanent Account Number (PAN) and
• 4 Certified true copy of the Power of Attorney granted to partner(s) or employee(s) of the Firm to enter into
transactions/ agreements on its behalf and their names and specimen signature(s) and
• 5 Certified true copy of any officially valid document* identifying the partners, employees and persons
holding the Power of Attorney and along with their recent Photograph and theirAddresses and PAN Card or Form
60, subject to the satisfaction of HDFC and
• 6 Certified true copy of the latest telephone bill or electricity bill or bank account statement or rent receipt
or agreement or letter from the Registered Society evidencing location of its office premises (in the name of firm/
partners), subject to the satisfaction of HDFC.
• * ‘Officially valid document’ has been defined to mean and include the passport, the driving license, , the Voter’s

• 1 Certificate of Incorporation of LLP or
• 2 LLP Agreement and
• 3 Certified True copy of Permanent Account Number in the name of the LLP/ PAN Allotment Letter and
• 4 List of all Designated Partner of LLP along with designated Partner Identification Number (DPIN) issued by the
Central Government.And /or Copy of consent letter of Designated Partner and
• 5 Certified true copy of the Resolution/Power of Attorney granted to Designated partner(s) or employee(s) of LLP
to enter into transactions/ agreements on its behalf and their names and specimen signature(s) and
• 6 Certified true copy of any officially valid document* identifying the partners, employees and persons holding the
Power of Attorney and their addresses, subject to the satisfaction of HDFC and
• 7 Certified true copy of the latest telephone bill or electricity bill or bank account statement or rent receipt or
agreement or letter from the Registered Society evidencing location of its Registered office premises (in the name of
LLP/ partners), subject to the satisfaction of HDFC.

Description of document that can be accepted for establishing the name & address of TRUSTS & FOUNDATIONS
• 1 Certified true copy of Certificate of Registration (if registered) and certified true copy of the Trust Deed and
• 2 Permanent Account Number (PAN) or Form 60 of the trust and
• 3 Certified true copy of the Power of Attorney granted to Trustees or Managing Committees or employees to transact
business on its behalf, their names and specimen signature(s) or
• 4 Certified true copy of the resolution passed by the Trustees or Managing Committee or Body in favor of office
bearers of the concerned Foundation/Association to transact on its behalf, their names and specimen signature(s) and

• 5 Certified true copy of any officially valid document* to identify the trustees, settlers, beneficiaries and those holding
Power of Attorney, founders / managers/ directors and along with their recent Photo graph and their addresses and
PAN Card or Form 60, subject to the satisfaction of HDFC and
• 6 Certified true copy of the latest telephone bill or electricity bill or bank account statement or rent receipt or
agreement or letter from the Registered Society evidencing location of its office premises (in the name of Trust/
Foundation), subject to the satisfaction of HDFC.

REGISTERED SOCIETY.
• 1 Certified true copy Registration Certificate under Societies Registration Act and
• 2 Permanent Account Number (PAN) and
• 3 List of Managing Committee members and
• 4 Committee resolution for persons authorised to act as authorised signatories with specimen signatures along
with their recent Photograph and
• 5 Society Rules and Bye Laws certified by the Chairman / Secretary
• * ‘Officially valid document’ has been defined to mean and include the passport, the driving license, , the Voter’s
Identity Card issued by the Election Commission of India, Job card issued by NREGA duly signed by an officer of the
State Government , proof of possession of Aadhaar Number and Letter issued by the National Population Register
containing details of name, address. or any other document of those individuals who are authorized to act for and on
behalf of any of the entities stated above as notified by the Central Government in consultation with the Reserve Bank
of India or as may be required by the Corporation.

UNINCORPORATED ASSOCIATION OR
BODY OF INDIVIDUALS
Description of primary document that can be accepted for establishing the legal name of
UNINCORPORATED ASSOCIATION OR A BODY OF INDIVIDUALS*
• 1 Resolution of the managing body of such association or body of individuals and
• 2 Certified true copy of the Power of Attorney granted to Managing body to transact business on its behalf, their
names and specimen signature(s) and
• 3 Permanent Account Number (PAN) or FORM 60 and
• 4 Certified true copy of any officially valid document* to identify the beneficiaries and those holding Power of
Attorney, managers and their addresses, with one recent photograph and PAN card of signatory subject to the
satisfaction of HDFC and
• 5 Certified true copy of the resolution of the managing body of the association / body of individuals.
• * ‘Officially valid document’ has been defined to mean and include the passport, the driving license, , the Voter’s
Identity Card issued by the Election Commission of India, Job card issued by NREGA duly signed by an officer of the
State Government , proof of possession of Aadhaar Number and Letter issued by the National Population Register
containing details of name, address. or any other document of those individuals who are authorized to act for and on

Description of document that can be accepted for establishing the name or address of a
Juridcal Person.
• 1 Documents showing name of person authorised to act on behalf of the entity/juridical person,
• 2 Aadhar/PAN/OVD for proof of identity and address in respect of the person holding an attorney to transact
on its behalf; and
• 3 Such other documents as may be required by HDFC to establish legal existence of such an entity /juridical
person
• * ‘Officially valid document’ has been defined to mean and include the passport, the driving license, , the Voter’s
Identity Card issued by the Election Commission of India, Job card issued by NREGA duly signed by an officer of
the State Government , proof of possession of Aadhaar Number and Letter issued by the National Population
Register containing details of name, address. or any other document of those individuals who are authorized to
act for and on behalf of any of the entities stated above as notified by the Central Government in consultation
