PATENTABILITY REQUIREMENTS

acquire these rights these requirements must be met
PATENTABILITY REQUIREMENTS
• First requirement: that it is an invention

It has as its main requirement, it must be an invention, it is the


very object on which the patent right rests.

Second requirement: that it is a novelty

The patent itself is only justified when a new contribution is


made to the technological and knowledge heritage.

It is required, also as a positive requirement, that there has been


a certain inventive step aimed at obtaining the technical rule.

An invention is considered to be capable of industrial application


when its object can be manufactured or used in any kind of
industry, including agriculture

• Industrial application refers to the utility in the sense of


"practicality" and "applicability" of the invention
