FACTS:
Appellant is being sued for rape of his 13-year-old daughter. The
daughter is living with his father together with her 2 sisters. The mother is
a domestic helper in Hongkong. The presiding judge, to avoid the
miscarriage of justice, ordered the prosecutor to amend the Information to
conform with the evidence, specifically, that the rape was committed while
the woman is unconscious instead of by the use of force and intimidation.
The RTC found him guilty and sentenced to die by lethal injection. He is
ordered to pay the victim P100k moral damages and P100k exemplary
damages. Upon review the CA sustained the decision but granted P75k civil
indemnity, P75k moral damages and P25k exemplary damages.
