Options in a contract:

Option means: Buyer has right to accept or reject a contract.

Mainly options are divided into:

1.Options are given by shari’ah (Khir Al- ‘Aib, Ruyah etc.).

2.Options based on buyer and seller ( Khir al- sharat, Khir al-
Ta’in etc.).
 Important types of options:

1. Khir al- Majlish (contractin session) :

seller and
buyer
have right to accept
or
reject
the contract within
a contracting session (Majlish).

seller and
buyer
can enforce any condition within the stipulated time
to accept
or reject the contract.

3. Khir al- ‘Aib (fault):

buyer and seller can accept
or
reject
a contract
if any fault involves
in exchanging of a contracting item.
 Condition of Khir al- ‘Aib (Fault)

• Fault should be existed before the thing is sold out.

• Fault affects the value of sold item.
• Fault Unknown to buyer.
• Seller does not purify sold item.
 The impact of the defect is required:

• The defect should be in the sold item.

• The defect has been existed previously.
• The defect should not be caused by the buyer before the sold item is captured.
• The defect has been existed continuously in the sold item until return it.
 Defect will be proved:

• Looking at the sold item.

• Knowledge of experienced people.
• Through experience.
• Women related issues should be referred to women.
 Cancelation of Khir al- ‘Aib (Fault)

• Satisfaction with the defect after knowledge of it.

• Destruction of thing (sold item) by the buyer.
• The absence of the defect before return the sold item.
• The seller declares from any faults.
• Sold item is changed by seller.
 Khir al- Ruyat (Option of looking):

4. Khir al- Ruyat (Option of looking):

Buyer can
accept
or
reject
a contract
in which he does not see the sold item.
 Cancelation of Khir al- Ruyat

• Allowing the fault after looking at it.

• Satisfaction with the defect.
• Sold item is changed by seller.
• Allowing any of shares with the defect.
• Death of buyer.
