Requisite for validity of treaty

a) Treaty-making capacity-every state possesses the capacity to

conclude treaties, as attribute of sovereignty
b) Competence of the representative concluding the treaty- Gen:head
of the state exercises the treaty making power.
c) parties must freely give consent –SERAAAA
DOCTRINE OF UNEQUAL TREATIES- treaties which have been imposed
(through coercion or duress) by state of unequal character is void.
