Legal Review Procedure in Nepal
A review committee formed by MOEST from
representatives among the proponent, National
Planning Commission, respective ministries or
departments, NGOs, MOEST and the public
(affected or interested population).
The committee first meets within 10 days of receiving
the report and submits its suggestions within 45
days to MOEST.
MOEST can include more experts or stakeholders
depending on the need and nature of the proposal.
The committee can form sub-committee too in
order to seek additional inputs.
MOEST can reconstitute or dissolve the committee at
any time seemed necessary.

Approaches to Report review
Grading and weighing:
• Acceptable (A): SD, TOR and the EIA reports
contain adequate information to decide on the
proposal (over or equal to 80 points)

• Acceptable with conditions (B): contains


incomplete information and some discrepancies
which can be corrected and thus the proposal is
accepted with some conditions (60-79 points)

• Inadequate (C): not adequate information and


contains major discrepancies. The issues need
to be resolved before any decision is made on
the proposal ( equal to or below 59 points)
