Introduction to the Act & Definition
 Introduction :
 An Act to provide the regulation & control of training of
apprentices and for matters connected therewith .

 Definitions
 (aa) "apprentice" means a person who is undergoing
apprenticeship training in pursuance of a contract of
apprenticeship;
 (aaa) "apprenticeship training" means a course of training
in any industry or establishment undergone in pursuance
of a contract of apprenticeship and under prescribed
terms and conditions which may be different for different
categories of apprentices
Objectives
 Apprentices Act, 1961 was enacted with the
following objectives :-
 
 To regulate the programme of training of apprentices
in the industry so as  to conform to the syllabi, period
of training etc. as laid  down by  the  Central  
Apprenticeship Council; and
 
 To utilise fully  the  facilities available in industry for
imparting practical training with a view to  meeting
the  requirements  of skilled manpower    for industry.
Objectives
 To create obligation on both Employer U &
Apprentice for abiding the Roles of the
Contract.
 Monitor payment to apprentices.
 Health, Safety & Welfares of apprentice
 Monitoring the Hours of Work, overtime,

leave & Holidays for Apprentices.


 Decide compensation for injury.
 Settlement of disputes.
 Offer & acceptance of employment
Important Terms
 "Apprenticeship Adviser" means the Central
Apprenticeship Adviser appointed under sub-section (1)
of section 26 or the State Apprenticeship Adviser
appointed under sub-section (2) of that section;
 (c) "Apprenticeship Council" means the Central
Apprenticeship Council or the State Apprenticeship
Council established under sub-section (1) of section 24;
 (d) "appropriate Government" means, Central Govt in
relation to the Central Apprenticeship Council, or the
Regional Boards, or Establishments of Govt & State Govt
in relation to State apprenticeship council or
establishment of state Govt.
Important Terms
 Graduate or Technician Apprentice
 Person who holds degree or diploma in

engineering or equivalent qualification


granted by the institution recogninsed by
Govt, who undergoes training in any such
related subject field.
 All India Council
 All India Council of Technical Education

(AICTE) established by the resolution of the


Govt of India in the Ministry of education.
Important Terms
 Graduate or Technician Apprentice
 Person who holds degree or diploma in

engineering or equivalent qualification


granted by the institution recogninsed by
Govt, who undergoes training in any such
related subject field.
 All India Council
 All India Council of Technical Education

(AICTE) established by the resolution of the


Govt of India in the Ministry of education.
Important Terms
 Board of State Council of Technical education
 Means board established by State Govt.
 National Council
 Means National Council for Training in Vocational Trades

established by the resolution of the Govt. in Ministry of


Labour.
 State Council
 Means SC for Training in Vocational Trades established

by State Govt.
 Designated Trade
 Any trade or occupation or subject in engineering /

technology specified by the Authorities.


 Trade Apprentice
 Who undergoes training in any such trade or occupation

as may be prescribed.
Training of Apprentices
 Qualification
 Person should not be less than 14 years of age.
 Needs to satisfy standards of education & physical fitness as
may be prescribed.

 Reservation needs to be done for Scheduled Castes & Tribes ,


Other backward Classes.

 Contract of Apprenticeship
 If minor Guardian needs to enter into contract with employer
for apprenticeship.
 Training starts from the day of the contract begins.
 Contents the agreed Terms of Conditions between the parties.
 Contracts needs to be registered by the Employer with in a
period as prescribed by Apprenticeship Adviser
Training of Apprentices
 The Adviser shall not register a contract if the
Apprentice is not qualified to under go the
Training in the designated trade specified in
the contract.
 Period of Apprenticeship training
 Termination of the apprenticeship contract –

expiry of contract, on application to


apprenticeship adviser by any party.
Practical & basic Training
 (1) Employer should make necessary arrangements in his
workshop for training.
 (2) Central Apprenticeship Adviser or any other
authorised person should be given reasonable facilities to
test whether training is given properly.
 (3) Any Apprentice before admission must undergo a
course of basic training.
 (4) Where 500 or more workers are working in any
establishment then apprentice training should be done
either in separate parts of workshop or in a separate
building.
 (5) Less than 500 workers training can be given in
institutes set up by the Govt.
Practical & basic Training
 (6) Such Training Institute can be located within the
premises or in the locality or convenient place can be
engaged by two or more employers.
 (7) In case of Apprentice other than graduate or
technician , the equipment used for training must be
approved by Central Govt. in consultation with Central
apprenticeship Council.
 In case of graduates or technicians the training &
facilities needs to be approved by authorities.
 (8) Recurring costs on Training will be born by employer
where 250 or more workers, & Govt. to certain limit
where less than 250 workers are employed.

APPRENTICE ACT 1961
.

Meaning:

The main purpose of this act is to provide practical


training to technically qualified persons in various
trades. The objective is promotion of new skilled
manpower. The scheme is also extended to
engineers and diploma holders.

Application :
The Act applies to areas and industries as notified
by Central Government
Contract of Apprenticeship
 Contract of Apprenticeship
 If minor, Guardian needs to enter into

NOVATION OF CONTRACT
 Contract of Apprentice with one employer
 Employer not able to fulfill his obligations
 Approval of Apprenticeship Adviser
 Transferred to the other employer for
unexpired period of apprenticeship training.
 Such agreement on registration shall be
deemed to be the contract of apprenticeship
with other employer.
 On & from date of such Registration the First
agreement shall get terminated & no
obligations under this act will be enforceable.
Instructions of Apprentice
 Instructions should be approved by Central
Govt giving theoretical knowledge necessary
for becoming fully qualified skilled craftsman.
 Related cost with instructions should be born
by Employer.
 Time spend by Apprentice for instructions will
be treated as part of his paid period of work.
 Trade apprentice who has undergone a course
of institutional training in authorised institute
& passed the examination will be given
reduced or modified scale of instructions.
Instructions of Apprentice
 For a graduate or technician apprentice
during training, if he has to get any
instructions from the Institue then the
Employer must release the apprentice for
receiving such instructions for the period as
prescribed in the law.
