WHS Induction: WHS Induction programs introduce staff, students,
visitors, volunteers and contractors
WHS LEGISLATION

The Work Health and Safety Act 2011 (NSW) (the Act)
provides a framework to protect the health, safety and
welfare of all workers and others in relation to NSW
workplaces and work activities.
Reviews are scheduled once every five years

since the Act was introduced
DUTY OF CARE

• In tort law, a duty of care is a legal obligation which is imposed


on an individual, requiring adherence to a standard of
reasonable care while performing any acts that could
foreseeably harm others.
• It is the first element that must be established to proceed with
an action in negligence
OBLIGATIONS OF WORKERS AT WORK

• While at work a worker must: take reasonable care


for their own health and safety. take reasonable care
for the health and safety of others. comply with any
reasonable instructions, policies and procedure given
by their employer, business or controller of
the workplace

• An employer and/or person conducting


a business or undertaking (PCBU)
must consult with workers when they are
likely to be or are directly affected by a
situation involving their health and
safety. ... As an employer, you
must consult when: identifying hazards and
assessing risks
HEALTH AND SAFETY POLICY AND
PROCEDURE

• A policy which focuses on workplace health and safety is central


to all operations and suits the nature and scale of your
organisation's risks. 
• Procedures are in place which set out the steps workers should
follow to perform specific work activities safely and meet
organisational policies and legislation.
