intrusive on students’ 4th Amendment rights
when weighted against school officials’
interest in providing a safe school

THE 4TH AMENDMENT RIGHTS OF STUDENTS

• The 4th Amendment of the Constitution says:


• The right of the people to be secure against
unreasonable searches and seizures, shall not be
violated.
• Government cannot make unreasonable warrantless
intrusions
APPLICATION OF THE 4TH AMENDMENT TO
STUDENTS
• In 1985, Supreme Court ruled that ”school officials are state agents, and all governmental
actions come within the restraints of the 4th Amendment”.

• The Court in T.L.O concluded that requiring teachers to obtain a warrant before searching
students would interfere with the informal disciplinary procedures needed to maintain
order.
