or will be prospects for commercial activities,
such as distribution, sale or licensing by
patent owner or licensee.
• Where it is practical and affordable to do so.
• Can afford costs: foreign atty. services &
govt. fees for filing, prosecution, annuities,
grant fees, & translations to/from other
languages.

to another country you will need an
EXPORT LICENSE, which takes the
form of a FOREIGN FILING

Convention
• The European patent system was
established by the European Patent
Convention (EPC)
• European Patent Office (EPO) administers
EPC procedures
• Provides patent protection in 25 European
countries on the basis of a single patent
application and a single grant procedure.

• European patent gives its holder the
same rights in the designated
contracting states as a national patent

What are the rights granted?
• European patent is a legal title
granting its holder exclusive right to
make use of an invention for a limited
area and time by stopping others from
making, using or selling it without
authorization

PROGRAMS NOT PATENTABLE
• EPC Article 52(2)(c): --schemes, rules and
methods to perform mental acts, playing
games or doing business, and programs
for computers, are not regarded as
inventions for which European Patents can
be granted.
• Even so, application can be filed in EPO

European patents with validity in Great Britain
(as designated state) may be extended to a
number of UK countries:
Anguilla, Belize, Virgin Islands (British), Falkland
Islands, Gibraltar, Cayman Islands, Jersey, St. Vincent,
Turks and Caicos, Tuvalu, Bahrain, Bermuda, Botswana,
Brunei, Fiji, Gambia, Ghana, Grenada, Yemen, Solomon
Islands, St. Lucia, Singapore, Swaziland, Trinidad and

the major expenses of dealing with
individual countries' patent offices for up to
30 months from original US filing date.
• May allow time for the international
business to develop or

• EPC “all eggs in one basket” approach
makes economic and logical sense if
enough EU countries of interest (or where
EP desired in France or Italy)
• EP can open protection to all of Europe,
and even the extension states mentioned
• EP in UK opens other UK counties

What does WIPO do?
• WIPO cooperates with intellectual property (IP)
offices, users and other stakeholders to develop
shared IP tools, services, standards, databases
and platforms.
• This technical infrastructure is designed to help IP
institutions collaborate more effectively and deliver
more efficient services to their users; as well as
enabling innovators and information-seekers
worldwide to freely access the knowledge
contained in the IP system.

What does WIPO do?
• WIPO provide human capacity building across the
full spectrum of intellectual property (IP)
rights: patents, trademarks, industrial
designs, geographical indications and copyright.
• Training takes place through in-depth programs
offered by the WIPO Academy or tailor-made
technical workshops.

WIPO:
• India is a member to several WIPO conventions
and treaties as detailed in the table below.
• India has recently acceded to the following WIPO
conventions.
• The accessions underline India’s strong
multilateral engagement with World Intellectual
Property Organization (WIPO) and also India’s
intent to create a strong regime for protection of
IPs.
