all times be accountable to the people, serve them with utmost responsibility, integrity, loyalty, and efficiency, act with patriotism and justness, and lead modest lives.” RA 6713 – “Code of Conduct and Ethical Standards for Public Officials and Employees”
approved by then Pres. Corazon C. Aquino
on February 20, 1989 took effect on March 25, 1989 implementing rules promulgated by the Civil Service Commission on April 21, 1989 PURPOSES/OBJECTIVES OF THE CODE
To uphold the time-honored
principle of public office being a public trust; To grant incentives and rewards for exemplary service; PURPOSES/OBJECTIVES OF THE CODE
To enumerate prohibited acts and
transactions; and
To provide penalties for violations
thereof. CHARACTERISTICS OF THE CODE
1. It has general applicability.

golden medallion, automatic promotion to next higher position, cash reward of Php200,000.00) DUTIES OF PUBLIC OFFICIALS AND EMPLOYEES 1. Act promptly on letters and request - Sent by the public within 15 days from receipt thereof. The reply must contain the action taken on the request. 2. Process documents and papers expeditiously or promptly - This means you must process and complete within a reasonable time from their preparation. The document must contain not more than three (3) initials or signatures. If the duly authorized signatory is absent, the officials next-in-rank or officer-in-charge should sign for and in his/her behalf. 3. Act immediately on the public’s personal transactions. - You must attend to anyone who wants to avail himself/herself on the services of your office, and you must at all times act promptly and courteously. This means you must not let your client wait for so long before you can give him/her request. 4. Make documents accessible to the public. - You are under obligation to provide official information, records or documents to any requesting public within reasonable working hours. 1. Public officials and employees shall not, directly or indirectly, have any financial or material interest in any transaction requiring the approval of their office. 2. Public officials and employees during their incumbency shall not own, control or manage or accept employment as officer, employee, consultant, counsel, broker, agent, trustee or nominee in any private enterprise regulated, supervised or licensed by their office unless expressly allowed by law. 3. Public officials and employees shall not engage in the private practice of their profession unless authorized by the Constitution or law, provided that such practice will not conflict or tend to conflict with their official functions. 4. Public officials and employees shall not recommend any person to any position in a private enterprise which has a regular or pending transaction with their office. 5. Public officials and employees shall not use or divulge, confidential or classified information officially known to them by reason of their office and shall not make them available to the public, either to (a) further their private interests, or (b) give undue advantage to anyone; or (c) to prejudice the public interest. 6. Public officials and employees shall not solicit or accept, directly or indirectly, any gift, gratuity, favor, entertainment, loan or anything of monetary value from any person in the course of their official duties or in connection with any operation being regulated by, or any transaction which may be affected by the functions of their office. 7. It shall be unlawful for any person to obtain or use any statement filed under this Act for: (a) any purpose contrary to morals or public policy and (b) any commercial purpose other than by news and communications media for dissemination to the general public. 8. Public officials and employees shall not indulge in extravagant or ostentatious display of wealth in any form. 9. Officials and employees shall not display ill or bad manners. 10. Officials and employees shall not withhold information. I. COMMITTING ANY VIOLATION OF THE CODE Fine not exceeding the equivalent of six (6) months salary; or
Suspension not exceeding one (1)
year; or
Removal depending on the gravity of
the offense after due notice and hearing by the appropriate body or agency. II. VIOLATION OF: Section 7 – Prohibited Acts and Transactions Section 8 – Statements and Disclosure Section 9 – Divestment 1. Imprisonment not exceeding five (5) years; 2. Fine not exceeding P5,000.00 or both. 3. And in the discretion of the court of competent jurisdiction, DISQUALIFICATION TO HOLD PUBLIC OFFICE. “Let us not become weary in doing good, for at the proper time we will reap a good harvest if we do not give up.
