Recommendations
Steps towards new Law
• In 1999, GOI appointed High Level Committee
on Competition Policy and Competition Law to
advise on strategies for modern competition
law in line with International development
• S.V.S. Raghavan, chaired the committee
• Unanimously deposed that MRTP Act had
outlived its time and a new law in tune with
the post-1991 paradigm was required
• Report submitted on May, 2000
Major Recommendations were:
• The Economic reforms of liberlisation,
deregulation & privatization need to be further
progressed & should be so designed that they
strengthen the Competition policy and vive-
versa
• Progressive reduction and ultimate elimination
of reservation for small scale industries
• The MRTP Act, 1969 may be repealed and
MRTP Commission to wound up
• UTP need not figure in Competition Act, as
they are already there in Consumer Protection
Act
• New Act on Competition to be enacted
• Proposed legislation should cover all kinds of
industries in the private and public sector
• Provisions should be able examine the anti-
competitive practices
• CCI establishment
• Role of Competition advocacy by CCI
