The Survivors Amount of Legitime


Art. 888 – LCD alone –½
Art. 889 – LPA alone –½
Art. 890 – The rule that the legitime for LP shall be divided equally between them (i.e, M & F).
If one of the parents is already dead, the whole shall pass to the survivor. If no F or M, but is
survived by ascendants of equal degree of the paternal and maternal lines, the legitime shall
be divided equally between both lines. If ascendants should be of different degrees,
the legitime shall pertain entirely to the ones nearest in degree of either line.

Art. 902 – No legitime here; just the provision that the rights of illegitimate
children are transmitted upon their deaths to their descendants
whether legitimate or illegitimate.
