 NATIONAL HUMAN RIGHT COMMISSION
The national human right commission is a standalone entity of the government of India
with the mission of protection human right. It is a statutory body mentioned in the
Constitution Of India that was established on 12th October 1993 under the “Protection Of
Human Right Act.”

 It is the watchdog of human rights, responsible for the protection and promotion of
human rights, defined by the act as “Right relating to life, liberty, equality and dignity of
the individual” guaranteed by the Constitution or embodied in the international
covenants and enforceable by court of India.

Introduction Of NHRC

 In 1991, a UN meeting in Paris has developed a detailed set of principles. The principles
became the foundation for establishment and operation of national human right
institutions.

 In pursuant if these principle, India has enacted protection of human right act, 1993,
with a view to bring about greater accountability and strengthening of the human rights
in the country. Section 2(b)

 Function And Power Of NHRC
 NRC has power to investigates grievances regarding the violation of Human Rights.

 It has the power to interfere in any Judicial proceedings involving any allegation of violation
of human rights.

 It can visit any jail or any institution under the control of the state Government to see the
living conditions of the inmates.

 It can review the safeguards provided under the constitution or any law for the protection
of the human rights.

NRC undertakes and promotes research in the field of human rights.

NHRC work to spread human rights literacy among various sections of society and
promotes awareness of the safeguards.

It has the powers of Civil Court and can grant interim relief.

It also has the authority to recommend payment of compensation or damages.

 Limitation Of NHRC
No investigating workforce
Viewed as ceremonial body
Only recommendatory power and no power to enforce decisions
 The NHRC does not consider the following cases:
• Cases that are older than one year. 
• Cases that are anonymous, pseudonymous or vague.
• Frivolous cases.
• Cases pertaining to service matters.

The NHRC has limited jurisdiction over cases related to armed forces.
