INTELLECTUAL PROPERTY
RIGHTS :

It is accepted universally
today, that Intellectual
property (IP) and
Intellectual property rights
(IPRs) are important in the
progress of nation
development, and are
considered as a barometer
of research and
development activities.
Introduction :
✔The main aim of this chapter is to give researcher an
experience of deep dive into the world of
Intellectual Property.
✔Following sections will help you to understand the
strategic value of IP and how IPR can be applied
to the research, “innovations and the artistic
creations by encouraging technology transfer”.
Intellectual Property :
✔ There are various forms of invention,creativity,research,innovations,
artistic creations that are covered by Intellectual property.
✔ In daily life, we come across various forms of IP like, literary work
(e.g.,Book), electronic devices(e.g.,Mobile),songs, movies,
pharmaceutical products etc.
✔ The legal rights covering IP are called as Intellectual property rights.
✔ For example, an original literary work and an invention are
intellectual property and when protected by the IPR, they will be
termed as“copyright”and“patent,”respectively.
There are Two types of
properties:
Physical Property Intellectual Property
It is the tangible property such It is the intangible property
as Land, Ornaments, such as Patent,
House,Money, Building, and so Copyright,Trademark, Design,
on. Geographical indications, and
so on.
Intellectual Property:
✔ Intellectual property laws differ in each jurisdiction. The implementation of IP
rights obtained distinctly in each territory of interest,is directed by the rule of
the country in force, namely the Law of Intellectual Property Rights.
✔ IPR is a tool for the owner of IP providing exclusive rights in the form of
Copyright,Patent, Trademark, Integrated Circuit, Geographical Indication, or
Industrial Design.
✔ The owner of IP acquires legal rights of his/her creations for a term period,
known as Term of IPR. Table(1) provides a summary of the types of intellectual
properties along with the duration, called as Term and the subject matter.

Difference between Industrial and
Intellectual Property :
✔ The word Property authorizes those articles that are normally acknowledged to
be an asset of a single entity or a group.For the ease of understanding, the IP can
be categorized as, Industrial Property and Copyright.
✔ Industrial Property refers to the industrialized intellectual yields, such as
patents, designs, trademarks, trade secrets,and so on.
✔ In addition to Industrial property, the Intellectual Property includes other rights
such as copyright for literary works, artistic works, software etc.
✔ However, today,it is common practice to use the word Intellectual Property as a
catch-all term that comprises of all properties resulting from the practice of
human brainpower.

✔ The colloquial definition of Intellectual Property can be stated as it
is that intangible property that is coming from the exercise of
human intellect, such as inventions, ideas,music, design, article,
poems, and so on.
✔ In short, Intellectual Property is about creative ideas.
✔ There is a wide range of creations covered in Intellectual
Property Rights, such as a copyright on an article or book, a
trademark, which is a logo that distinguishes its logo design
signifying a firm and its services, a patent on the invention or
innovative design/process, various trade secrets, geographical
indication such as Darjeeling Tea, trade-related aspects such as 11
Significance of Intellectual Property
Rights :
✔ In the modern business model, concepts and understanding are
important from the business point of view. A major worth of
pharmaceutical and cutting-edge technology products lies in the extent
of innovation, research, design and testing, invention involved.
✔ For business growth of any enterprise today, it is important to protect
the novelty in the form of IP because it is a key element required to
maintain a competitive point in the marketplace.
✔ IP is an integral part of the commercial process. The supervision and
protection of IP can mean the difference between victory and
disappointment in business today. 12
✔ The Movies, music rendition recordings, theater renditions, books, computer
applications, and online facilities are basically traded due to the originality of
content.
✔ Many commodities that used to be imported or exported, now contain
innovation and design in their goods, like brand-named products/clothing.
✔ Therefore,inventors are given the Intellectual property rights to inhibit others
from using their foundations, inventions, or designs.
✔ Thus, IPRs are the key handlers of economic performance in Research and
Development–based business models by preventing others from infringing
the original creation.
✔ It is to be noticed that rationalization of the implementation of the rights
ensued is restricted to the territory/country which permits such rights and
cannot be extended beyond the province of the that country.
