Supreme Court- is the highest court within the hierarchy of courts in many legal jurisdictions.

POWERS OF SUPREME COURT

1. Exercise original jurisdiction over cases affecting ambassadors, other public ministers and consuls,
and over petitions for certiorari, prohibition, mandamus, quo warranto, and habeas corpus.

2. Review, revise, reverse, modify, or affirm on appeal or certiorari, as the law or the Rules of Court
may provide, final judgments and orders of lower courts in:

• All cases in which the constitutionality or validity of any treaty, international or executive
agreement, law, presidential decree, proclamation, order, instruction, ordinance, or
regulation is in question.

• All cases involving the legality of any tax, impost, assessment, or toll, or any penalty imposed
in relation thereto.
• All cases in which the jurisdiction of any lower court is in issue.

• All criminal cases in which the penalty imposed is reclusion Perpetua or higher.

• All cases in which only an error or question of law is involved.

3. Assign temporarily judges of lower courts to other stations as public interest may require. Such
temporary assignment shall not exceed six months without the consent of the judge concerned.

4. Order a change of venue or place of trial to avoid a miscarriage of justice.

5. Promulgate rules concerning the protection and enforcement of constitutional rights, pleading,
practice, and procedure in all courts, the admission to the practice of law, the integrated bar, and
legal assistance to the underprivileged. Such rules shall provide a simplified and inexpensive
procedure for the speedy disposition of cases, shall be uniform for all courts of the same grade, and
shall not diminish, increase, or modify substantive rights. Rules of procedure of special courts and
quasi-judicial bodies shall remain effective unless disapproved by the Supreme Court.

6. Appoint all officials and employees of the Judiciary in accordance with the Civil Service Law.
Duties and function of supreme court
Its principal function is the supervision and administration of the lower courts throughout the
Philippines and all their personnel. It reports and recommends to the Supreme Court all actions that
affect the lower court management.

MEMBERS OF THE SUPREME COURT

The Supreme Court shall be composed of a:

• Chief Justice
• The Senior Associate Justice
• 11 Associate Justices
Members of the Supreme Court are required to have:

• probity and independence


• they must be natural-born citizens of the Philippines
• at least forty years old
• with at least fifteen years of experience as a judge of a lower court or law practice in the country.

Justices shall hold office during good behavior until they reach the age of seventy years, or become
incapacitated to discharge the duties of office.
CURRENT ISSUES OF THE SUPREME
COURT
Dino s. Palo VS. Senator crewing (manila) inc., Et sl.

DECISION:
Before us in an appeal by certiorari under rule 45 of The rules of court filed by petitioner Dino Palo
asylum the resolution dated September 3 2014 of the Court of appeals

FACTS OF THE CASE:


RESPONDENT COMPANY SENATOR CREWING. Foreign principal Columbia ship management ltd.
Hired palo as six months contract term . On September 24 2011 and after being declared as fit to work in
his pre employment medical examination, palo was deployed onboard the vessel Verlaine.

DECISION:
SOMETIME IN THE FIRST WEEK OF DECEMBER 2011 AND WHILE WORKING ON ABOARD THE
VESSEL. PALO carried a container weighing 25 kiloliters. Down the engines upper floor. Palo suddenly
felt the snap of his back and the pain began radiating down to his hips. Palo continued to work as the
pain was initially tolerable. However palo was repatriated do to the end of his employment contract.
Upon arrival in the Philippines follow was not provided medical attention by the company designated
physicians.
On April 25 2012 palo signed another 6 month contract with SCI as oiler on board. Is employment
contract is covered by a collective bargaining agreement. Before deployment follow was subjected to
another peme. Where he was declared fit to his duty. Palo claimed that he was no longer subjected to a
magnetic resonance .

Palo was suffered in injury but the company of what he was working was not claimed or palo should
not be paid disability benefits due to his disclosing a previous diagnose relating to his back condition.
WHEREFORE, the resolution dated September 3 2014 of the court of appeals in CA-G.R SP No. 136807
is set aside. Respondents senator crewing ordered petitioner dino S. Palo.

1. $60000.00 representing and total disability benefits under the Philippine overseas employment
administration standard employment contract

2. Sickness allowance if none been paid and

3. Attorney fees ten percent of the monetary award.


2nd Current Issue:

We all know that covid is a very dangerous so the alert levels of the guidelines in metro manila is
that the operational capacity of the offices/services in the Supreme court begin in October 1, 2021
shall remain at not exceeding fifteen percent of staff in deferent offices. It also state here that for
those who will physically report on a rotation basis will be determined by the respective chiefs of
offices and services, and the individual health conditions of the staff will thoroughly check up upon
entering the court premises. In the other hand those offices/services reside in areas place under the
granular lockdown or a micro level quarantine (critical zone) , they shall be replaced by those
residing in areas which is have a lower alert levels. The remaining work force shall under a work
from home arrangement or WFH employees who are under the agreement are advised to stay at
home except if they have urgent necessities to do. Or in general the supreme court declare that only
15% consisting of only absolutely essential staff in deferent offices and for those who is under in
critical zone place will be replace by those residing areas with lower alert of covid cases and the
remaining work force will undergo a work form home.
