RIGHTS AND
RESPONSIBILITIES
1. LABOR CODE OF THE
PHILIPPINES
 The Labor code of the Philippines governs
employment practices and labor relations in the
Philippines.

 It is also identifies the rules and standards regarding


employment such as pre-employment policies, labor
conditions, wage rate work hours, employee benefits,
termination of employees and so on.

 The State shall protect labor, promote full


employment, provide equal work opportunity
regardless of gender, race, or creed; and regulate
relations between employees and employers.

WORK DAYS AND WORK HOURS
 An employee must be paid their wages for all
hours worked. If their work hours fall between
10:00 p.m. and 6:00 a.m., they are entitled to
night shift pay in addition to their pay for regular
work hours. If they work over eight hours a day,
they are entitled to overtime pay.

 A day-off of 24 consecutive hours after six (6)
days of work should be scheduled by the
employer upon consultation with the workers.

EMPLOYMENT OF CHILDREN  
 The minimum employment age is 15 years of age. Any
worker below 15 years of age should be directly under the
sole responsibility of parents or guardians provided that
work does not interfere with the child’s schooling or
development.
 The minimum age of employment is 18 years for
hazardous jobs, and 15 years for non-hazardous jobs.

HAZARD OCCUPATION (HO)
◈ Driving a motor vehicle and being an outside helper on a motor
vehicle.
◈ Coal mining
◈ Forest fire fighting and fire prevention, timber tract management,
forestry services, logging, and saw mill occupations.
◈ Power-driven metal-forming, punching, and shearing machines.
◈ Meat and poultry packing or processing (including the use of
power-driven meat slicing machines).
◈ Roofing operations and all work on or about a roof.

HAZARD PAY IN THE PHILIPPINES
 Hazard pay, also called hazard allowance or hazardous
duty pay, is compensation paid in addition to regular
salary to workers who perform hazardous duties or whose
work involves physical hardships.
 Hazard pay in the Philippines is given to qualified
employees either as a fixed monthly rate or as a
percentage of the monthly basic salary.

HAZARD PAY COMPUTATION FOR PUBLIC HEALTH
WORKERS

 Public health workers (PHWs) in the Philippines receive a


hazard allowance of at least 25% (salary grade 19 and
below) or at least 5% (salary grade 20 and above) of their
monthly basic salary..

Overseas employment
 As for overseas employment of Filipnos, foreign
employers are not allowed to directly hire Philippine
nationals except trough board and entities authorized
by the secretary of Labor.

 Travel agencies also cannot transact or help in any


transactions for the employment and placement of
Filipino abroad.

WAGE AND WAGE-RELATED BENEFITS
 Wage is the amount paid to an employee in
exchange for to the service that they rendered to
their employer. Wage may be fixed for a given
period.

PAYMENT OF WAGES
 Wages should be paid directly to the employee
in cash, legal tender, or through a bank.
 Wages shall be given not less than once every
two weeks or twice within a month at intervals
not exceeding 16 days.

Minimum wage rate
 Minimum wage rate in the Philippines vary from
region to region, with board established for each
region to monitor economic activity and adjust
minimum wages based on growth rates,
unemployment rates and other factors.

 All the rank and file employees of the private
sector are entitled to 13th month pay regardless
of their position, designation, employment status
or wage payment method provided that they
have worked for at least one month during the
calendar year.

 Each of the 16 regions in the Philippines
has its own Regional Tripartite Wages and
Productivity Board which sets minimum
wage rates for their respective region.
