• TRIPS
• TRIPS (Trade-Related Aspects of Intellectual Property Rights) is an agreement
under the World Trade Organization (WTO) that sets out minimum standards for the
protection and enforcement of intellectual property rights (IPRs) in member
countries. India became a signatory to TRIPS in 1995.
• WIPO
• WIPO (World Intellectual Property Organization) is a specialized agency of the
United Nations that promotes the protection of intellectual property throughout the
world. India is a member of WIPO and has signed several treaties and conventions
administered by WIPO.
• In India, IPR is protected by various laws, including the Patents Act,
1970, the Copyright Act, 1957, the Trade Marks Act, 1999, the Designs
Act, 2000, and the Geographical Indications of Goods (Registration and
Protection) Act, 1999. India has also established various institutions and
bodies for the administration and enforcement of IPR, such as the Patent
Office, the Trademark Registry, and the Copyright Office.
• India has made significant efforts to comply with the TRIPS agreement
and has amended its IPR laws to meet the minimum standards set out in
the agreement. However, there have been some concerns raised about
the impact of strong IPR protection on access to essential medicines and
other important technologies in India.
• Overall, IPR protection in India continues to evolve, and the country is
actively engaged in international discussions and negotiations on IPR
issues.
