SERVICE OF NOTICE OF

TAKING GUIDELINES
SEND NOTS ONLY TO THE REGISTERED OWNER- IF THE
SOMEONE CLAIMS THAT THEY ALREADY BOUGHT IT FROM
THE REGISTERED OWNER- DO NOT SERVE THE NOT- PREPARE
A TABLE OF THESE CASES THEN SEND IT TO ARUP FOR
UPDATING- - IF THEY HAVE A DEED OF SALE, ASK THEM TO
TALK TO THE LANDOWNER TO COORDINATE WITH US,
UNLESS THEY ALREADY HAVE A CERTIFICATE AUTHORIZING
REGISTRATION FROM THE BIR- IN SUCH CASE, SERVE THE
NOT TO THEM
• Take note of the following: ( Prepare a table)
• a. Refuse to receive (execute the affidavit of service and put in
folder)
• b. Received but refuse to sign the acknowledgment- print another
NOT and indicate in the acknowledgment portion that the property
owner refused to sign the acknowledgment receipt;
• c. Property owner cannot be found after 3 attempts (execute the
affidavit of service) (In above-mentioned cases- consider the NOT
as served)
• Case handlers must personally follow up the submission of documents (contact the
landowners and ask them to submit all documents) use your personal number.
• Case handlers take care of the individual folders;
• Send all RFDs to those who have already received the NOTs- no need to wait for the
complete submission of documents;
• For new batch of NOTs- serve the NOTs together with the RFD- must explain to the
landowners that they are not required to donate the property- serving the RFDs is just part of
the procedure;
• If the landowner DOES NOT OWN THE STRUCTURES, but the structure was built WITH
HIS CONSENT and he EXECUTED A WAIVER- proceed to the normal process of
acquisition;
• Prepare the expropriation folder- make sure that all requirements are secured
