Labour Legislation
• The term ‘Labour Legislation’ is used to cover all the laws
which have been enacted to deal with employment and non-
employment, wages, working conditions, industrial
relations, social security and welfare of persons employed in
industries.

• It covers all the laws of the Government to provide social


and economic security.
Objective of Labour Legislation
• Preservation of Health, Safety and Welfare

• Maintenance of good relation between employer and


employee.

• Social security and equality

• Promote machinery to solve industrial dispute

• Better service conditions.

TRADE UNIONS IN NFL
• In the words of Indian trade union act 1926 section 2(h) says that – “A trade union is
any combination , weather temporary or permanent ,formed primarily for the
purpose of regulating the relation between workmen and employers and employees ,or
for imposing restrictive conditions on the conduct of any trade or business ,and any
federation of two or more trade union "

Trade union in Sister Units
• Name- National fertilizer ltd employee union (NFEU)
• NFEU is the single registered trade union operating in Sister
Units.
• Nangal Unit is a multi union system.
Bi-partite Committees in Nangal Unit

1. Plant level committee


• Chairman : Shri S.K.Srivastava, Chief General Manager
• 11 members from each side
• The committee shall discuss the matters relating to : -
• 1 . Operational areas 2. economic & financial matters
3. personnel matters 4. welfare matters
5. environmental areas
Works committee
• Section 3 of The industrial Act, 1947
• Chairman : Smt . Gurinderjit Kaur ,DGM (TS&P)
• The works committee shall endeavor to promote measures
for securing and preserving amity and good relation
between the employer and workmen and to that end , to
comment upon matter of their common interest or concern
and endeavor to compose any material difference of
opinion in respect of such matters .
• 7 members from each side.
Canteen Managing Committee
• Chairman : sh. B.M. Jha , DGM(P)
• 3 members from each side
• The above committee shall discuss the matters relating to :
1. maintenance of quality & quantity of foodstuffs being
served in the canteen .
2. arrangement of menu programme .
3. fixation of timing of meals in the canteen .
Any another matter concerning to canteen management .
Sports committee
• Chair man : Sh. S.K. Jindal ,DGM (Mech.)
• 7 members from each side
• The functions of sports committee will be to :
1. promote sports activities.
2.Arrange such facilities , as are necessary for development of
sports .
3.Suggest such measures , which may help in promotion of
sports (Half- Marathon).
4.Procure sports material necessary for sports.
5. organize tournaments after allocation of budgets for
sports activities form C.O.
Employees Special Welfare Committee
• Chairman : sh. D.S.Tomar ,CM(HR)
• 3 members from each side
• The above committee shall discuss the matters relating to :-
• 1. provide relief to the hard cases inside the establishment .
• 2. undertaking Welfare Projects in the neighborhood.
Labour laws w.r.t Contract labour -
• The Contract labour (Regulation & Abolition Act), 1970 &
Ease of Compliance to maintain registers under various
Labour Laws Rules, 2017.
• The Payment of wages Act, 1936.
• The Minimum wages Act, 1948.
• The Factories Act, 1948.
• The Employee State Insurance Act, 198
• Payment of Bonus Act, 1965.
• The EPF & M P Act, 1952.
Who is a Contract Labour ?
• Section 2 (b) of CL( R&A) Act, 1970 defines :
• Workman is hired through a contractor for a job in
connection with the establishment with or without the
knowledge of the Principal Employer.

• Number of Contracts :-
• More than 30 contracts for factory area, township and
admin building

• More than 20 contractors


Requirements for deploying Contract Labor

• Registration of Principal Employer under


CLRA Act.
• License for contractors (Form III & Form VII)
• Compliance of Section 10 of CLRA Act
Major issues related to deploying Contract Labor
• Wage issue (Minimum wage) &Timely
disbursement of wages
• Working Hours/ Overtime
• Provident Fund (PF)
• ESI/ Insurance
• Working conditions and Welfare Facilities
• Statutory Bonus
Mechanism for CL Management
• As a Principal Employer , NFL has to ensure
Compliance of applicable Labor Laws before making
payment to contractor.
• Therefore, an internal arrangement for compliance of
above direction has implemented in the form of COC (
Certificate of Compliance)

• Objective : To check the compliance done by


contractor in respect of all applicable labor laws.
