WHY RAILWAY IS BETTER FOR CARRIAGE OF
GOODS THAN OTHER ALTERNATIVES

• Railroads are less expensive than trucks, but they often offer a poorer quality of
service. The gap in prices for shipments of items that are less profitable for trucking
can be significantly bigger, or the industry may not be able to successfully compete for
the freight at all.
• Railroads are a bit more expensive but quicker alternative to inland waterway barge
shipping. For a variety of bulk railroad products with lower timing requirements.
THE PROCESS OF TRANSPORTING PRODUCTS
• First a consignor has to fill out a paper called the
FORWARDING NOTE.
• It includes information on the items, the quantity of
packages, the sender and recipient's addresses, the
degree of the sender's liability, if freight is paid or
must be paid, etc.

• When the forwarding note is submitted to the


railway parcel office, the office will issue a second
note known as the Railway Receipt.
• This is a very for the person receiving the products.
RAILROAD DUTIES

• The Railway has some rules and duties they need


to fulfill to keep everything running smoothly.
• Obligation to provide the necessary facilities for
the prompt receipt, transportation, and delivery of
products.
• Requirement to refrain from giving an unfair or
unjustifiable preference or advantage to any
specific individual or category of goods.
• The duty to follow any instructions issued by the
government regarding the shipment of goods
LIABILITY FOR THE SAFETY OF THE
PRODUCTS
• Whether the products are transported at "owner's risk" or "railway risk" in the forwarding
notice. Except in the following circumstances, the railway is liable for any loss or
destruction if the items are transported at its risk. Some of them are:
• Act of God.
• Act of war.
• Act of public enemies.
• Latent defects.
• Negligence of the consignor or the consignee.
LIABILITY OF THE RAILWAY

• Liability for wrong delivery-

The railway should not be liable on the grounds that the recipient of the goods it delivered
in good faith to is not legally entitled if the recipient presents the original railway receipt.
• Liability as a carrier of animals.
• Liability after termination of transit-
Whether goods are transported at the risk of the railroad or the owner, the railroad's liability for
the duration of seven days is the same as a bailee under the Contract Act of 1872. Seven days after
the end of the transportation, the railway will no longer be responsible for any losses or damages.
RELEASE FROM RESPONSIBILITY

The Railway cannot be held accountable for liability if –

• When the items are sent with a fake description


• Where either the consignor or the consignee has engaged in fraud
• When a loss is brought on by faulty loading or unloading, a riot, a civil disturbance, a
strike, a lockout, a cessation of work, or labor restraint
