Based on amount of control you have….

Consider contract of service vs. contract for service


•Contract of service = work is totally under your control
•Contract for service = work is under their own control

Fine balance between too much control and not enough control
(both situations could leave you liable)
Contractor Vetting and Selection

Generally employers are not liable for the negligence of


independent contractors carrying out their work…
However they may be implicated if contractors are not
competent

Careful vetting and selection process in order to:


•Prevent accidents
•Comply with legal duties
•Defend civil and criminal actions
