Belligerents and Insurgents
 Belligerents are entitled to special rights and obligation
in the special circumstances of conflict under Law of War.
 Insurgents come into being through their struggle
against the state to which they belong.
 It is based on: rights to self determination, rights to
choose economic, political and social systems, and rights
to exploit natural resources within its occupied
territories.

 The group of people make an action to separate
themselves from the sovereignty of a state. They
possess half of national territory and real authority.
 Because insurgents are a destabilizing factor, States
are reluctant to accept them or take them into
account, unless they can show some of the attributes
of sovereignty.
 They acquire power through force, their existence
is by definition provisional: they either prevail and
turn into fully fledged States, or are defeated and
disappear.

 The notion is primarily dependent on the de
facto administration of specific territory along
with the valid arrangements.
 Belligerent and insurgent bodies within a State
may enter into legal relations and conclude
agreements on the international plane with
States and other belligerents and insurgents.
 That way, they may acquire de facto authority in
control of a specific territory.

 Belligerent and Insurgents are bound by the
rules of IL wrt the conduct of hostilities and
may in due course be recognized as
governments.
