CULPABLE HOMICIDE

The term ‘Culpable’ means “criminal” and ‘Homicide’ means


“killing of a human being by another human being.” Section 299
of the Indian Penal Code, 1860 defi nes Culpable Homicide as
“Causing death of a human being with the intention of causing
death or with the intention of causing such bodily injury as is
likely to cause death.”
CULPABLE HOMICIDE NOT AMOUNTING
TO MURDER (SEC.299)

An act done with the intention of causing death or causing such bodily
injury which is likely to cause death or having the knowledge that he can
likely by his act cause death, he’ll be committing the off ense of culpable
homicide.

CONDITIONS

1.The intention of causing death.

2.The intention of causing such bodily injur y as is likely to cause death.

3.With the knowledge that he is likely by such an act to cause death.


CULPABLE HOMICIDE AMOUNTING TO
MURDER(SEC.300)

Culpable homicide is murder, if the act is done with the


intention of causing death or if it is done with the intention of
causing such bodily injury as is likely to cause the death of the
person or if the inflicted bodily injury is sufficient enough in
the ordinary course of nature to cause death or if there is
knowledge involved that the act done is so fatal that in all
probability it can cause death or such bodily injury as is likely
to cause death and commits such act without any excuse.
CONDITIONS

1.T he intention of causing death.

2.T he intention of causing such bodily injur y as the off ender knows to
be likely to cause the death of the per son to whom the harm is caused.

3.W ith the intention of causing bodily injur y to any per son and the
bodily injur y intended to be in ­fl icted is suffi cient in the ordinar y
course of nature to cause death.

4.T he per son committing the act knows that it is so imminently


dangerous that it must, in all probability, cause death or such bodily
injur y as is likely to cause death, and commits such act without any
excuse for incurring the risk of causing death or such injur y as
aforesaid.
