Education –A Critical Analysis

 The bar council (BCI) is a statutory body that regulates and represents the Indian
bar. It was established under section 4 of the advocates act 1961 . In recent times
the horizon of BCI is increasing.
 BCI has seen the rise in legal education about fifty years ago the concept of the law
school was very different and more of the convention but through the efforts of
BCI and other authorities , the image of legal education right now is more practical.
 Protect the rights, privileges, and interests of advocates. To promote and support
legislation reform . To deal with and dispose of any issue that may be referred to it
by a state bar council . To promote legal education and establish requirements for
legal education.
What is Bar Council

 The bar council of India is statutory body created by parliament to regulate and represent the
Indian bar . We perform the regulatory function by prescribing standards of professional
conduct and etiquette and by exercising disciplinary jurisdiction over the bar . We also sets
standards for legal education and grants recognition to universities whose degree in law will
serve as qualification for enrolment as an advocate. The bar council’s legislative and
representative mandate for the legal professional and legal education in India is outlined in
section 7, the following statutory functions are included in section 7.
 Advocates should have set up rules of professional conduct and etiquette.
 Protect the rights , privileges and interest of advocates.
 To promote and support law reform.
 Any matter that may be referred to it by a state bar council is dealt with and dealt with.
 The disciplinary commission and the disciplinary committees of each state bar council
here by establish a procedure for implementing.
Composition of BCI

 Each bar council shall consist of fifteen members .


 One shall be the advocate general.
 Four shall be persons nominated by the high court , of whom not more than two
may be judges of that court.
 Ten shall be elected by the advocates of the high court from amongst their
number.
 The elected members of every bar council not less than five shall be persons
who have for not less than ten years been constituted .

The bar council of india may be a member of international legal organizations.
International bar association.
International legal aid association.
Authorizes expenditure on the participation of its members in any international legal
conference or seminar.

 Prohibition of strikes and Boycotts.


 Advocates must be treated with respect and dignity by the bar council of
india.
 Advocates who participate in strikes or boycotts will be disciplined by the
state bar council.
 Advocates are compelled to ignore calls for strikes or boycotts.
 The bar council’s decision to refuse to participate in legal assistance
programs or disrupt court proceedings is both illegal and null.

Conclusion

 The Bar Council of India has the following power and functions . Its primary purpose as
defined by the advocates act 1961 is to regulates and represent legal practitioners in India
. The council ensures that ethical conduct is followed by advocates by having the
authority to set up rules of professional conduct.
 By promoting legislation reform, it also protects their rights and interests.
 Bar council of India being a sole custodian of the advocates across India must ensure
that every advocate who is has enrolled his name as an advocate must be treated with
dignity and respect in their field of practice.
 The BCI must set up the several education centre to enhance the knowledge of the
advocates specially for the young advocates.
 The BCI must provide financial assistance to the young and financially weak advocates.
 BCI has the huge scope to uphold and ensure benefits of the lawyers.
