Constitution
A constitution is a set of fundamental legal-political rules that:

(1) are binding on everyone in the state;

(2) concern the structure and operation of the state;

(3) are harder to change than ordinary laws;

(4) meet the internationally recognized criteria for a democratic system in terms
of representation and human rights.

These are the qualities of an item that are essential to ensure


that the intended use of the item can be realized.

Salient features of the constitutions are the dominant


characteristics that are essential to ensure the solemn
expression of the will of the people of Bangladesh.

The Constitution of The People’s Republic of Bangladesh is a written one, and
has a formal document. With 153 articles, 7 schedules, 10 parts and 1 preamble.

Rigid

The constitution of Bangladesh is a rigid one. It cannot amend by the ordinary


law making procedure, and very difficult to modify or change. Only vote of two
third majority of parliament members can amend this constitution.

Preamble

The constitution of Bangladesh starts with a preamble. This is the


guiding basis of the constitution. Preamble lays down the most
important national goals such as Democracy, Socialism, Nationalism
and Secularism.

Supremacy

Article 7 provides that “this constitution is the supreme law of the


republic”. And it is the fundamental law of the country, if any other
law is inconsistent with this constitution shall be void.

Unitary Government System

Article 1 provides that Bangladesh is a unitary republic. In unitary


Government system constitution is central power of the state.

Unicameral Legislature

Articles 65 of the constitution provides a unicameral legislature for


Bangladesh. It is only one house to be known as the ‘House of
Nation’.

Directive Principle

Article 8-25 of the constitution provides the directive principles of


the state. These are called fundamental principles of the state.
Government must ensure these principle on the governing policy.
These principles are not enforceable by order of the court.

Fundamental Rights

Fundamental rights are absolute rights of a citizen of a country.


Article 27 to 44 of the constitution provide 18 fundamental rights.
These rights are enforceable by order of the court under Article 44
of the constitution.

The constitution of Bangladesh provides a Westminster type of

Independence of judiciary
The ability of courts and judges to perform duties free of
influence or control of others. Article 22 provides that the State
shall ensure the separation of the judiciary from the executive
organs of the State.

Ombudsman

Article 77 of the constitution provides a ombudsman system to


overview the activities of civil bureaucracy, to eradicate corruption
in the administration and to ensure the responsibility of the
government.
