Creation: It can be created through wills, trusts, or other legal instruments. It allows a person (the life
tenant) to have the right to use and enjoy the property for their lifetime, after which the property typically
reverts to another person or entity (the remainderman).
Rights and Obligations: Similar to usufruct in Argentina, the life tenant in the UK has the right to use,
possess, and enjoy the property during their lifetime. They can collect income or rent from the property and
may have obligations to maintain it.
Termination: A life interest in the UK terminates upon the death of the life tenant or according to the terms
specified in the legal instrument, such as a will or trust deed.

El derecho real de superficie es un concepto legal que permite a una persona
poseer, construir y utilizar una propiedad inmobiliaria que pertenece a otra persona
durante un período de tiempo determinado. Aunque existen similitudes en el
concepto de derecho real de superficie en Argentina y el Reino Unido, también
existen diferencias importantes debido a las diferencias en los sistemas legales y
las leyes de propiedad de cada país.
En Argentina, el derecho real de superficie se rige
principalmente por el Código Civil y Comercial de la
Nación. Bajo este sistema legal, una persona puede obtener
un derecho real de superficie sobre un terreno o una
propiedad y construir en él, mantener la posesión y
disfrutar de los beneficios durante un período de tiempo
especificado. Al final de ese período, la propiedad revertirá
al propietario original, a menos que se haya acordado una
prórroga. El derecho de superficie en Argentina puede ser
otorgado por un plazo de hasta 50 años, y generalmente
implica el pago de una tarifa o canon al propietario del
terreno.
In the United Kingdom, the real right of gross area is known as "leasehold"
and is more related to the ownership of properties in apartment buildings or
residential complexes. Under this system, a person can purchase a property
in a building or complex and has the right to use it for a specified period of
time, typically long-term, which can last for decades or even centuries.
Although "leasehold" is similar in some aspects to the real right of gross
area, there are significant differences in terms of how it is administered and
regulated.
