Short title & Extent.


 This Act may be called the Information Technology Act, 2000.  It shall extend to the whole of India and, save as otherwise provided in this Act, it applies also to any offence or contravention there under committed outside India by any person.

Definitions
 Computer" means a electronic magnetic, optical or other high-speed data processing highdevice or system which performs logical, arithmetic, and memory functions by manipulations of electronic, magnetic or optical impulses, and includes all input, output, processing, storage, computer software, or communication facilities which are connected or related to the computer in a computer system or computer network.

 Digital signature" means authentication Digital signature" of any electronic record by a subscriber by means of an electronic method.  Electronic record" means data, record record" or data generated, image or sound stored, received or sent in an electronic form or micro film or computer generated micro device.

 "asymmetric crypto system" means a system" system of a secure key pair consisting of a private key for creating a digital signature and a public key to verify the digital signature.  "Certifying Authority" means a person Authority" who has been granted a license to issue a Digital Signature Certificate

 Private key" means the key of a key pair used to create a digital signature.  Public key" means the key of a key pair key" used to verify a digital signature and listed in the Digital Signature Certificate.

Digital signature.
Digital signature" means authentication signature" of any electronic record by a subscriber by means of an electronic method.  Any subscriber may authenticate an electronic record by affixing his digital signature.

 The authentication of the electronic record shall be effected by the use of asymmetric crypto system and hash function which envelop and transform the initial electronic record into another electronic record.  "hash function" means an algorithm mapping or translation of one sequence of bits into another

 Secure digital signature. By application of a security procedure, it can be verified that a digital signature, at the time it was affixed, waswas(a) unique to the subscriber affixing it; (b)capable of identifying such subscriber;

(c) created in a manner or using a means under the exclusive control of the subscriber and is linked to the electronic record to which it relates in such a manner that if the electronic record was altered the digital signature would be invalidated, then such digital signature shall be deemed to be a secure digital signature.

Electronic governance.
 Electronic Governance (E-Governance) (Eis broadly defined as an application of Information technology to the functioning of the Government.  E-Governance involves access to government information and services.

 E-gov relies heavily on the effective use of Internet and other emerging technologies to receive and deliver information and services easily, quickly, efficiently and inexpensively.

Uses of E-Governance. E Government monitoring and enforcement agencies like State excise, Health, Commercial taxes, etc. can uniquely identify companies for streamlined interaction.  This also helps speed up Government processes and procedures resulting in streamlined Government - Industry interface across all Government departments. 14

Electronic record
 Electronic record" means data, record or data generated, image or sound stored, received or sent in an electronic form or micro film or computer generated micro fiche.

Use of electronic records


 Where any law provides forfor(a) the filing of any form. application or any other document with any office, authority, body or agency owned or controlled by the appropriate Government in a particular manner. (b) the issue or grant of any license, permit, sanction or approval by whatever name called in a particular manner. (c) the receipt or payment of money in a particular manner.

Certifying authorities.
 Appointment of Controller The Central Government may, by notification appoint a Controller Assistant Controllers of Certifying Authorities.

Functions of Controller.
(a) exercising supervision over the activities of the Certifying Authorities. (b) certifying public keys of the Certifying Authorities. (c) laying down the standards to be maintained by the Certifying Authorities. (e) specifying the conditions subject to which the Certifying Authorities shall conduct their business.

(g) specifying the form and content of a Digital Signature Certificate and the key. (h) specifying the form and manner in which accounts shall be maintained by the Certifying Authorities. (l) resolving any conflict of interests between the Certifying Authorities and the subscribers; (m) laying down the duties of the Certifying Authorities.

(j) The Controller shall be the repository of all Digital Signature Certificates issued under this Act. (k) Every Certifying Authority shall ensure that every person employed or otherwise engaged by it complies, in the course of his employment or engagement, with the provisions of this Act, rules, regulations and orders made there under. 20

Offences
 Tampering with computer source documents.  Hacking with computer system.  Publishing of information which is obscene in electronic form.  Power of Controller to give directions.
