Upstate Laboratories Inc. of East Syracuse tested samples for clients, some requiring quick turnarounds where chemical degradaton was at issue. Authorites say the lab routnely changed dates on results that werent completed within specifed tmes. More than two-dozen afected clients included Oswego Countys health and solid waste departments, A&P Water Testng of Morrisville and the Oneida- Herkimer Solid Waste Authority. Prosecutors say Upstate Laboratories has agreed to pay a $150,000 fne, which will be suspended if it pays resttuton. The company will also be on probaton for fve years. Sentencing is scheduled Dec. 4. Dr. Kim Dyce Faucete Bikers cruise through Syracuse on eight-day Erie Canal excursion 500 bicyclists wheeled through Syracuse Wednesday during the Cycling the Erie Canal bike tour. The 15th annual, eight day event joins cyclers from the age of 4 to 89 from more than 36 states. Sunday, the riders started in Bufalo and planned to arrive in Albany Sunday. The Rosamond Giford Zoo and the Erie Canal Museum in Syracuse will be their stops along the way. The 361-mile trail will be the longest statewide trail in the country, when the gaps in the trail are closed. Syracuse Woman is Crowned Miss New York Syracuse natve, Nina Davuluri was crowned Miss New York Saturday night. The 24 year old competed for the ttle against 24 other contestants at the St.George Theater. She received a scholarship worth $10,000 and will compete, representng New York for the Miss America Pageant in Atlantc City September 15. 4 www.cnyvision.com | july 18 - 24| 2013 LOCAL www.cnyvision.com Wal-Mart Supercenter Conversion Finished Afer a year of renovatons, Wal-Mart on Basile Rowe is now a supercenter. Now open 24 hours, the store has a bigger variety of groceries and new general items. The store was 120,000 square feet and is now 157,000 square feet and all of the stores departments were refurbished including larger produce, meat, dairy and frozen food sectons. The inside as well as the outside of the locaton has been revamped with more surrounding landscaping. A new supercenter will be built in Clay at the site of a Sams Club that closed in 2010. Wal-Mart has not released any informaton as to the cost of the project. Syracuse Orange returning to practice at Fort Drum SYRACUSE, N.Y. (AP) - Rookie Syracuse coach Scot Shafer is bringing the team back to Fort Drum for preseason training camp for the second straight year. The Orange will travel north to the military post during the week of Aug. 12 to contnue a bond it shares with the military personnel at the Army base. With help from the famed 10th Mountain Division, the Orange will incorporate elements of military training into the daily preseason camp. The team will practce on Sligh Field, hold meetngs in a batalion headquarters, eat in a mess hall and sleep in barracks. Players and coaches also will partcipate in various military actvites, including Army physical training and small unit leadership seminars. The week will culminate with a scrimmage Aug. 15 in front of the soldiers and their families. Renz pleads guilty to killing woman, raping girl SYRACUSE, N.Y. (AP) - An upstate New York man who cut of his electronic monitoring bracelet, then raped a 10-year-old girl and killed her mother has pleaded guilty to murder and sex charges. David Renz admited in county court Wednesday morning that he carjacked the two at Great Northern Mall on March 14, stabbing the mother to death as she tried to prevent him from raping her daughter. He had been under federal monitoring afer a child pornography charge. The 29-year-old Renz pleaded guilty to state charges of frst-degree murder and sexual assault against a child. He is expected to be sentenced to life in prison without the possibility of parole, but the plea bargain can be withdrawn if the federal government seeks the death penalty. Man, 22, fatally shot on Syracuse street SYRACUSE, N.Y. (AP) Police in Syracuse are investgatng the fatal shootng of a 22-year-old man. Ofcers tell local media outlets that they were called to Knaul Street around 12:20 a.m. Tuesday. They found Karon Cole wounded and unresponsive outside a home. Police say he was taken to Upstate University Hospital and was pronounced dead a short tme later. Detectve, for short Verizon to introduce installment plans for phones PETER SVENSSON NEW YORK (AP) - Verizon Wireless, the countrys largest cellphone carrier, on Thursday said its joining AT&T and T-Mobile in providing an installment plan for its phones, aiming to satsfy customers who want to upgrade their devices faster or avoid paying the upfront cost of their phones. The plan, dubbed Edge, will be introduced Aug. 25, and allows the buyer to spread the full retail price of the phone, without subsidies, over 24 months. A buyer who has paid of 50 percent of the cost of the phone can upgrade to a new phone afer six months. We have a lot of customers in the technology edge that want to upgrade sooner than they would under our historical, legacy, subsidy model, if you will. And we have other customers who dont want to pay upfront for the large cost of the phone, Verizon Communicatons Inc.s chief fnancial ofcer, Fran Shammo, told analysts on a conference call Thursday. Now that nearly every adult American has a cellphone, easy growth in the wireless industry has ended, and carriers are looking to other avenues for growth. One way to do that is to boost phone sales, but most phones are sold at a big loss, so any gains in phone sales under the traditonal model are counterproductve. The phone companies subsidize the cost of, for example, an iPhone, by hundreds of dollars to get retail price down to $200. With Edge, Verizon isnt paying a subsidy, and the buyer shoulders the entre cost the phone. That means frequent upgrades help Verizon rather than hurt it. For customers, Edge makes fnancial sense only if they are unwilling to deal with the hassle of selling their old phones when they want to upgrade to a new device; for those buyers, the trade-in opton is convenient. Rumors about Verizon Edge had surfaced on several blogs earlier this week. Compettor T-Mobile US Inc. stopped signing up customers for two-year service contracts in March, in favor of selling phones on installment plans. To further cater to frequent upgraders, it introduced an opton called Jump last week It provides device insurance and more frequent upgrades for $10 a month. On Tuesday, AT&T announced its own frequent-upgrade opton, called Next, which is very similar to Verizons Edge. Startng July 26, customers will be able to buy their phones on installment plans, with the opton to trade in the devices afer a year. Shammo made his comments while discussing the companys second- quarter results on a conference call with analysts. Verizon Wireless added 941,000 devices to its contract-based plans in the April to June period, exceeding analyst estmates and contnuing a strong run. It boosted service revenues by 8.3 percent from a year ago. Its closest rival, AT&T, is seeing revenue increases of around 4 percent. Almost all of the gains on the wireless side were due to customers upgrading to higher-priced plans or adding more devices to their plans, as opposed to an infux of new customers. Analysts saw some weakness in the results, pointng to a decline in the proft margins on the wireless side, and Shammos comment that the rate of device upgrades would be roughly the same as last year. Because the company subsidizes each new smartphone by hundreds of dollars, frequent upgrades are costly. Verizon shares fell $1.15, or 2.3 percent, to $49.60 in morning trading. It was the frst tme the shares went below $50 this month. The shares hit a 12-year high of $54.31 on the last day of April. Shammo said margins were in line with the companys own forecasts, and that the slight miss compared to analyst expectatons was due to the large number of new subsidized devices added to the network. Net income at Verizon Communicatons was $2.25 billion, or 78 cents per share, up 23 percent from a year ago, the company said Thursday. Excluding a pension-related gain, earnings were 73 cents per share. That beat the average estmate of analysts polled by FactSet by a penny. Revenue was $29.79 billion, up more than 4 percent from a year ago and in line with analyst expectatons. New York-based Verizon Communicatons owns 55 percent of Verizon Wireless, which means that only that percentage of its profts fow to its botom line. The rest goes to joint venture partner Vodafone Group PLC, a Britsh cellphone company with wide-ranging internatonal interests. Verizon Communicatons has a long- standing interest in buying Vodafone out of Verizon Wireless, and analysts expect a deal could be reached later this year. Shammo had no comment Thursday on the prospects for a deal. Shammo reiterated that Verizon is interested in buying into the Canadian wireless market, since there is a government aucton coming up for a band of the airwaves that Verizon already uses in the U.S. However, the company is only in the early stages of exploring a Canadian venture, he said. 6 www.cnyvision.com | july 18 - 24| 2013 COVER By Hazel Trice Edney (TriceEdneyWire.com) President Barack Obamas surprise address to the naton identfying with the anger and hurt over the Trayvon Martn not- guilty verdict, has won praise from supporters and detractors alike. As the naton antcipated Saturdays protests in cites across the naton in response to the not-guilty verdict in the shootng of the unarmed teenager, President Obama walked into the Brady Press Room at the White House around 1:30 on Friday and gave unscripted remarks on racial strife in America that were uniquely personal. You know, when Trayvon Martn was frst shot I said that this could have been my son. Another way of saying that is Trayvon Martn could have been me 35 years ago. And when you think about why, in the African-American community at least, theres a lot of pain around what happened here, I think its important to recognize that the African-American community is looking at this issue through a set of experiences and a history that doesnt go away, he said in the 20-minute statement, televised live on some statons. There are very few African-American men in this country who havent had the experience of being followed when they were shopping in a department store. That includes me. There are very few African- American men who havent had the experience of walking across the street and hearing the locks click on the doors of cars. That happens to me - at least before I was a senator. There are very few African- Americans who havent had the experience of getng on an elevator and a woman clutching her purse nervously and holding her breath untl she had a chance to get of. That happens ofen. He contnued, And I dont want to exaggerate this, but those sets of experiences inform how the African-American community interprets what happened one night in Florida. And its inescapable for people to bring those experiences to bear. The African-merican community is also knowledgeable that there is a history of racial disparites in the applicaton of our criminal laws - everything from the death penalty to enforcement of our drug laws. And that ends up having an impact in terms of how people interpret the case. His comments were met with praise from Black leaders, who welcomed his candidate remarks. That our president has been profled should encourage all Americans to think deeply about both the depth of this problem and how our country moves beyond it, said NAACP President/CEO Benjamin Todd Jealous. The Presidents call to examine the role state laws, including Stand Your Ground, play in compounding racial profling is especially welcome. Let us move forward to bring justce for Trayvon Martn and toward a more united naton that is truly safe for all Americans. A statement from the Lawyers Commitee for Civil Rights Under Law also applauded the President: As the President eloquently stated - drawing from his own personal experience African-Americans in this country have experienced a long history of prejudice that led to strong emotonal reactons about the Zimmerman verdict, about the jury and about an American justce system that convicts Blacks in signifcantly larger numbers than whites and other racial groups. President Obamas remarks took some of the stng of of the stunning verdict; especially since he has rarely spoken to race issues and had never used such personal examples. But, not everyone was pleased. The Zimmerman defense team released a response statement saying the verdict was released fairly and justly. The defenses statement contnued that they acknowledge and understand the racial context of this case, but added, We challenge people to look closely and dispassionately at the factsWe believe those who look at the facts of the case without prejudice will see that it is a clear case of self- defense, and we are certain that those who take a closer look at the kind of person George Zimmerman is. Actually, President Obama was careful not to speak negatvely of the jurys verdict. The judge conducted the trial in a professional manner. The prosecuton and the defense made their arguments. The juries were properly instructed that in a case such as this reasonable doubt was relevant, and they rendered a verdict. And once the jury has spoken, thats how our system works, he said. He said he only intended to put into context the pain of African-Americans in response to the verdict. This strategy drew compliments from at least one of his biggest critcs. Republican Sen. John McCain told CNNs State of the Union that Obamas remarks were very impressive. McCain added, I think we contnue to make progressWe stll have a long way to go. The NAACP and other civil rights advocates have pressed for federal interventon in the Zimmerman case, including the possibility of a federal civil rights prosecuton. The president was careful not to assert his involvement in Holders investgaton and announced no upcoming policy proposals to reverse some of the ways that Black are treated. But, he clearly listed what he perceives as some of the answers. Speaking of racial profling, he said it would be productve for the Justce Department, governors, mayors to work with law enforcement about training at the state and local levels in order to reduce the kind of mistrust in the system that sometmes currently exists. In reference to the stand your ground self- defense laws, he said it would be useful for us to examine some state and local laws to see if they are designed in such a way that they may encourage the kinds of altercatons and confrontatons and tragedies that we saw in the Florida case, rather than difuse potental altercatons. As a long term project he said, we need to spend some tme in thinking about how do we bolster and reinforce our African-American boys. And this is something that Michelle and I talk a lot about. There are a lot of kids out there who need help who are getng a lot of negatve reinforcement. And is there more that we can do to give them the sense that their country cares about them and values them and is willing to invest in them? He was clear that he was not speaking of a new federal program,but hinted that he may call on aspects of the community to discuss next steps. I do recognize that as President, Ive got some convening power, and there are a lot of good programs that are being done across the country on this front. And for us to be able to gather together business leaders and local elected ofcials and clergy and celebrites and athletes, and fgure out how are we doing a beter job helping young African-American men feel that theyre a full part of this society and that theyve got pathways and avenues to succeed - I think that would be a prety good outcome from what was obviously a tragic situaton. The President suggested that open conversatons be had about race. I think its going to be important for all of us to do some soul-searching. There has been talk about should we convene a conversaton on race. I havent seen that be partcularly productve when politcians try to organize conversatons. They end up being stlted and politcized, and folks are locked into the positons they already have. On the other hand, in families and churches and workplaces, theres the possibility that people are a litle bit more honest, and at least you ask yourself your own questons about, am I wringing as much bias out of myself as I can? Am I judging people as much as I can, based on not the color of their skin, but the content of their character? That would, I think, be an appropriate exercise in the wake of this tragedy. In conclusion, the President urged Americans to become beter angels of our nature by using the negatve episodes to gain greater understanding rather than heighten divisions. He said: Were becoming a more perfect union; not a perfect union, but a more perfect union. Obama Remarks on Zimmerman Verdict Draw Accolades President Suggests Next Steps 7 www.cnyvision.com | july 18 - 24| 2013 NATIONAL Trayvon Martins parents shocked by verdict MIAMI (AP) - Trayvon Martns parents made appearances on network morning shows Thursday, saying they are stll shocked that jurors acquited George Zimmerman in the 2012 shootng death of their 17-year-old son. On NBCs Today show, Sybrina Fulton questoned whether jurors looked at the shootng from her sons point of view. He was a teenager. He was scared. He did run, Fulton said, who added that she believes the justce system failed her son. We didnt get the verdict we wanted because we wanted him to be (held) accountable. Martns father, Tracy Martn, expressed disbelief in the verdict handed down Saturday by a six- woman jury following a three-week trial in central Florida. We felt in our hearts that we were going to get a convicton, Martn said. We felt that the killer of our unarmed child was going to be convicted of the crime he commited. On ABCs Good Morning America, Tracy Martn said he felt the jury did not get a chance to get to know the teen. They didnt know him as a human being, he said. Martns parents said they stll believe Zimmerman, who identfes himself as Hispanic, racially profled their son. Obviously, any tme you have a person that makes an assumpton that a person is up to no good, thats some kind of profling, Martn said. Was he racially profled? I think if Trayvon had been white, this never would have happened. Martns parents said they support the federal government looking into the case. The Justce Department announced Sunday it plans to review the case to determine whether federal prosecutors should fle criminal civil rights charges now that Zimmerman has been acquited. Zimmerman, who was charged with second-degree murder, claimed he shot Martn in self-defense. Martns mother said she believes the verdict sends a terrible message to other litle black and brown boys. They cant walk fast. They cant walk slow. So what do they do? How do they get home without people assuming you are doing something wrong?, Fulton said. Fulton told CBS This Morning her son was not a burglar. He simply went to the store and was headed back home, she said. And for somebody to look at him and perceive that he was a burglar, that was the problem that initated everything. Tracy Martn and Sabrina Fulton 8 www.cnyvision.com | july 18 - 24| 2013 NATIONAL 22 children die after eating school lunch in India INDRAJIT SINGH PATNA, India (AP) - At least 22 children died and more than two dozen others were sick afer eatng a free school lunch that was tainted with insectcide, Indian ofcials said Wednesday. It was not immediately clear how chemicals ended up in the food in a school in the eastern state of Bihar. One ofcial said the food may not have been properly washed before it was cooked. The children, between the ages of 5 and 12, fell ill Tuesday soon afer eatng lunch in Gandamal village in Masrakh block, 80 kilometers (50 miles) north of the state capital of Patna. School authorites immediately stopped serving the meal of rice, lentls, soybeans and potatoes as the children started vomitng. Savita, a 12-year-old student who uses only one name, said she had a stomach ache afer eatng soybeans and potatoes and started vomitng. I dont know what happened afer that, Savita said in an interview at Patna Medical College Hospital, where she and many other children were recovering. The lunch, part of a popular natonal campaign to give at least one daily hot meal to children from poor families, was cooked in the school kitchen. The children were rushed to a local hospital and later to Patna for treatment, said state ofcial Abhijit Sinha. In additon to the 22 children who died, another 25 children and the school cook were in hospital undergoing treatment, P.K. Sahi, the state educaton minister. Three children were in serious conditon. Authorites suspended an ofcial in charge of the free meal scheme in the school and registered a case of criminal negligence against the school headmaster, who fed as soon as the children fell ill. Angry villagers, joined by members of local oppositon partes, closed shops and businesses near the school and overturned and burned four police vehicles. Sahi said a preliminary investgaton suggested the food contained an organophosphate used as an insectcide on rice and wheat crops. Its believed the grain was not washed before it was served at the school, he said. However, local villagers said the problem appeared to be with a side dish of soybeans and potatoes, not grain. Children who had not eaten that dish were fne, although they had eaten the rice and lentls, several villagers told the AP. Sinha said the cooked food and kitchen utensils have been seized by investgators. Whether it was a case of negligence or was intentonal, we will only know once the inquiry has been conducted, he said. Indias midday meal scheme is one of the worlds biggest school nutriton programs. State governments have the freedom to decide on menus and tmings of the meals, depending on local conditons and availability of food ratons. It was frst introduced in southern India, where it was seen as an incentve for poor parents to send their children to school. Since then the program has been replicated across the country, covering some 120 million school children. Its as part of an efort to address concerns about malnutriton, which the government says nearly half of all Indian children sufer from. Although there have been occasional complaints about the quality of the food served, or the lack of hygiene, the tragedy in Bihar appeared to be unprecedented for the massive food program. JOSH LEDERMAN WASHINGTON (AP) - In 1999, a fresh- faced state senator on Chicagos South Side heard consttuents complain that police were free to pull over drivers because they were black. So Barack Obama proposed a bill to tackle racial profling. When it failed, he revised it and proposed it again and again. Race and ethnicity is not an indicator of criminal actvity, Obama said when his bill fnally passed the Senate four years later. He said targetng individuals based on race was humiliatng and fostered contempt in black communites. More than a decade later, Obamas eforts to pass groundbreaking racial profling legislaton in Illinois ofer some of the clearest clues as to how Americas frst black president feels about an issue thats polarizing a naton roiled by the shootng death of black teenager Trayvon Martn. Obama has spoken only rarely about his own experience with incidents he perceived to be race-related. In his 2006 book The Audacity of Hope, he described his struggles with the injustces of driving while black and the vigilance he felt was stll necessary for him and his family. I can recite the usual litany of pety slights that during my 45 years have been directed my way: security guards tailing me as I shop in department stores, white couples who toss me their car keys as I stand outside a restaurant waitng for the valet, police cars pulling me over for no apparent reason, Obama wrote. Obamas administraton has treated gingerly the acquital of George Zimmerman, the man who fatally shot Martn. Burned in the past by injectng himself into racial fare-ups, Obama is wary of taking sides this tme afer, in his words, a jury has spoken. While Martns family has said the teenager was racially profled, race was barely mentoned during the natonally televised trial. Now that the state trial is over, the Justce Department is looking into Martns death to see whether civil rights charges can be fled. Federal prosecutors would have to show evidence Zimmerman was motvated by racial animosity to kill Martn. The president, in his only public comments on the verdict, looked to the future, urging Americans to ask themselves how such tragedies can be prevented. These days, its gun control that Obama cites. But as a young state senator, he and a few colleagues led a fght to require police to keep track of the demographics of drivers they pulled over - race, gender and age - then have those records analyzed to root out any paterns of bias. Diversity training was also part of the package, and another bill Obama pushed sought to prevent wrongful convictons by requiring police to videotape interrogatons for crimes like homicide. Emil Jones Jr., the state Senates president at the tme, said he told Obama he was countng on him to shepherd the profling bill, part of a broader judicial overhaul involving death penalty reform that Jones said was his top priority. It called on him to work with legislators on both sides of the aisle, Jones said in an interview. There was strong oppositon from law enforcement on these issues. He was skillful enough to be able to get them on board. One of Obamas key arguments to woo skeptcal police groups was to say his legislaton could actually exonerate fair-minded ofcers. Those unjustly accused of racial profling would, for the frst tme, have evidence to show that wasnt the case. Both the racial profling and videotaped interrogatons bills eventually passed through the Legislature in 2003. When it frst became law, the data showed blacks and other minorites were being pulled over about three tmes as ofen as whites, said Craig Futerman, who sits on the statewide panel that oversees the law. These days, its down to about twice as ofen, he said. The fact that this data was being collected and monitored actually dramatcally reduced racial profling in Illinois, said Futerman, a professor at the University of Chicago Law School, where Obama once taught. It didnt eliminate it - there are stll unacceptable racial inequalites. In the Zimmerman case, civil rights leaders say Zimmerman racially profled the unarmed teenager when he followed him through a gated community and shot him. But Zimmerman says Martn physically assaulted him and he shot the teenager in self-defense. But across the U.S., as rallies crop up flled with protesters demanding justce for the teenager whose quest to buy Skitles ended in death, its not clear what steps the administraton may take. I dont have any process to announce today going forward, said Jay Carney, Obamas spokesman. We have been t h o r o u g h l y trained to believe that getng angry about the c o n d i t i o n s which plague our community is not only a professional death certfcate, but also an unacceptable label. Jews can be angry about the Israels protecton, whites can get angry about 7% unemployment. But when it comes to black people, some think we shouldnt be angry about anything. I dont agree with this noton, not in the least. Dr. Ivory Toldson, an emerging and powerful scholar at Howard University, recently posted a Facebook status about his struggles of being labeled as an angry, emotonal black scholar. This is what Dr. Toldson had to say: Emotonally loaded and needlessly contentous were the words of a reviewer who rejected my manuscript to a top ter journal in 2003. These words were a painful blow to my confdence at the tme. Justfably angry and sufciently arrogant were the words from a positve critque of a young scholar who used one of my artcles to frame a graduaton speech. These words made me refect on who I was 10 years ago, and who Id ultmately become. Im glad I didnt let a pety blind reviewer suppress my emotons and cause me to fear confrontaton, simply to appease a gatekeeper to an arena that has no respect for me or my people. Black scholar actvists, be emotonal, be contentous, be angry, be arrogant, and be brave! I found myself cheering afer reading Ivorys status, because this is exactly what we need: Scholars willing to break out of the chains that are latched onto their powerful minds. In order to be truly efectve, these men and women must maintain a willingness to assertvely engage the public on issues that mater most to their community. This goes far beyond sitng in a classroom teaching 30 white kids every semester. Most of us know the grisly statstcs in the black community that we are up against: An unemployment crisis of epic proportons, neighborhoods that have become virtual warzones, an out-of-control HIV epidemic, traumatc educatonal systems, and an incarceraton problem that threatens to annihilate the next generaton. With all of this going on, Im not quite sure if we can aford to allow our best and brightest minds to rot away behind the walls of the ivory tower, where everything seems to happen in theory, but almost nothing in reality. Dr. Toldson and I dont talk much, but I admire his work from afar. In fact, I actually admire him more than I admire myself. He and I were both part of the Janks Morton flm, Hoodwinked, (along with Drs. Jawanza Kunjufu, Steve Perry and Marc Lamont Hill). What I loved most about this project is the idea of a group of highly-educated black men aggressively defending their community. Not that women shouldnt be an important part of the dialogue (i.e. Dr. Tyra Seldon, Dr. Julianne Malveaux, Yvete Carnell, etc.), but I think black mens feet must be held to the fre as the frst line of defense for our families and communites. Call me old-fashioned, but I believe that men must be wired to protect and provide for the people they love, and when we put our minds to it, we become the most powerful force in the universe. Strong black scholars, in general, must be commited to also being intellectual warriors. Ability means nothing without courage, and an idea is worthless if you are too afraid to open your mouth and share it. An educated, fearless, conscientous African American is probably the greatest threat to white supremacy that there is. Thats why our oppressors seek to control our minds from the day we are born. For every rapper on the radio preaching a toxic message of black self- destructon, we need a scholar, pastor, parent or teacher giving an alternatve message of black empowerment and liberaton. We are at war people, and we must be as determined, focused and persistent as the forces seeking to mold us. George Zimmerman was found by a jury of his peers to be not guilty of second degree murder. We do not know how the jury came to its conclusion or why. What we do know is this: TheUSAonWatch manual that describes the code of conduct for neighborhood watch programs states: It should be emphasized to members that they do not possess police powers and they shall not carry weapons or pursue vehiclesMembers should never confront suspicious persons who could be armed and dangerous. George Zimmerman ignored that code of conduct. We also know that on that rainy February 26th evening when Zimmerman called the Sanford County Police and told the dispatcher that a suspicious teenager was wandering through the neighborhood, F---ing punks ... These a--holes, they always get away he was directed not to follow Trayvon Martn. He was told to disengage. Zimmerman ignored that directve. We know that an armed 28 year-old George Zimmerman followed an unarmed 17-year-old Trayvon Martn. Zimmerman initated contact with Trayvon; an encounter ensued and Zimmerman fatally shot Trayvon. Zimmerman initated contact, shot and killed an unarmed teenager, and claimed self-defense? Secton 776.013 of the Florida Criminal Code, Home protecton; use of deadly force; presumpton of fear of death or great bodily harm states, (3)A person who is not engaged in an unlawful actvity and who is atacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony. The clear intent of this law is to protect law abiding citzens and allow them to use deadly force when they are approached and feel threatened by another person. You cannot initate the encounter and later claim self-defense or stand-your-ground. Trayvon Martn was not engaged in an unlawful actvity (he was walking home from the store) and he was approached at night by a strange man in a place where he had every right to be. Based upon these facts, Trayvon had no duty to retreat and had the right to stand his ground and meet force with force. If Zimmerman had followed the age old adage, Dont start nothin; wont be nothin Trayvon Martn would be alive today. The only reason Zimmerman felt empowered to engage Trayvon was because Zimmerman knew he possessed the equalizer; he was armed. The State of Florida correctly charged George Zimmerman with second degree murder. Second degree murder is defned as, the unlawful taking of human life with malice but without the other aggravatng elements of frst degree murder; i.e. without deliberaton or premeditaton. - Blacks Law Dictonary 5th editon. Had the prosecuton stuck to these basic elements and not allowed itself to be sucked into the confusing morass of who was screaming for help, etc. I believe that Zimmerman would be back in jail awaitng sentencing not at home with his family celebratng the verdict. Was George Zimmerman acquited based upon race? I do not know the answer to that queston. I was not in the jury room and have not had the opportunity to talk with any of the jurors. I do know that according to Discriminatory Acquital Modem statstcs show contnuing disparites in convictons and sentencing based upon the race of the victm Discriminatory acquitals consttute a massive and efectvely ungoverned consttutonal problem rarely mentoned by scholars and never addressed by courts. When all of this is said and done, I can only imagine that the parents of Trayvon Martn mourn for him like Emmet Tills mother mourned for the tragic murder of her son. America is stll America to me.
