MOTION FOR STAY OF IMPRISONMENT AND POSTTRIAL RELEASE UPON APPEAL To the extent a prison term is imposed by the Court, defendant Dominic Badaracco, through counsel, moves, pursuant to Practice Book 43-31, to stay the sentence pending disposition of the appeal; and pursuant to General Statutes 54-63f and 54-95 and Practice Book 43-2, to release him pending disposition of the appeal upon a reasonable bond. In support thereof, defendant states that he intends to appeal the judgment of conviction within the time prescribed in General Statutes 54-95 and Practice Book 63-1, et seq., that he intends to raise meritorious issues, that he has been at liberty since his arrest without incident, that there is no evidence that he will fail to appear in Court when called or that he will constitute a danger to the community if allowed to remain on release, and that the a reasonable bond is more than adequate to assure his appearance and/or to satisfy any other concerns of the Court.
