The High Ecclesiastical Court of the Serbian Orthodox Church consisting of the following
members: the President of the High Ecclesiastical Court, His Grace Amfilohije Metropolitan of
Montenegro and of the Coastal Lands, and the following members of this Court: His Grace
Hrizostom, Bishop of Zica, and His Grace Hrizostom, Bishop of Bihac-Petrovac, and the
following honorary members: Very Reverend Dr. Radomir Popovic, and Reverend Dr. Dragomir
Sando, both of them priests laymen and also professors at the Theological Faculty of the Serbian
Orthodox Church, and: Reverend Dr. Luka Novakovic, the Clerk of the High Ecclesiastical
Court, and also the Director of the Patriarchates Office, have convened in Belgrade on 27
December 2007, and as per their official duties and in accordance with Article 79 of the
Constitution of the Serbian Orthodox Church have made the following:

VERDICT

This Court hereby confirms the Verdict made by the Ecclesiastical Court of the Eastern
American Diocese CSBr.7, of 7 September 2007, which quashes the punishment of
excommunication from the Church community for the following members of the C{O from
Niagara Falls, Ontario, Canada: Mr. Dushan Kolundzic, Mr. Aleksandar Pantelic, Mr. Zivorad
Zico Jovanovic, Ms. Milena Dancuo, Mr. Simo Bijelich, and Mr. Mihajlo Savic.
His Grace Georgije, Bishop of Canada is hereby instructed to do the following: immediately
upon receipt of this Verdict to revoke his banishment of Liturgical practice in the Church of the
Holy & Great Martyr St. George in Niagara Falls, in order to improve the very unpleasant
atmosphere, and to overcome the problems that have arisen in the Church School Congregation,
so that Church and Community life can normalize.
The C{O in Niagara Falls and its membership is hereby ordered to regulate their status and
registration in accordance with the Constitution of the Serbian Orthodox Church in the United
States of America and Canada.

EXPLANATION

At the request of the Ecclesiastical Court of the Diocese of Canada Br.344 of 19 July 2006, and
in accordance with Article 80 of the Constitution of the Serbian Orthodox Church, this High
Ecclesiastical court in its Act Br.8 of 20 May 2007, had delegated this case for deliberation to
the Ecclesiastical Court of the Eastern American Diocese, as a neutral Court in this case, and a
Court of the first degree. The Ecclesiastical Court of the Eastern American Diocese has studied
the case, examined the accused, and in the allotted time delivered a judgement, which was
forwarded on 9 November 2007 to the High Ecclesiastical Court in Belgrade for their
deliberation and final verdict.
After carefully examining this case, including all relevant documentation submitted, as well as
the judgement of the Ecclesiastical Court of the Eastern American Diocese CSBr.7 of 8
September 2007, which quashed the punishment of excommunication from the Church of the
above named persons, and revoked the suspension of Liturgical practice within the Church of the
Holy & Great Martyr St. George in Niagara Falls, this Court confirms this judgement.
On the basis of Article 79 of the Constitution of the Serbian Orthodox Church, as well as Article
77 of the Penal Code for the Ecclesiastical Court of the Serbian Orthodox Church, and having in
mind the well being of the Church, the High Ecclesiastical Court puts this Verdict into force.
In accordance with Article 87 of the Penal Code for the Ecclesiastical Court of the Serbian
Orthodox Church, the decision of the High Ecclesiastical Court is final and must be executed,
without the possibility of appeal.

Povodom spora vladike Georgija i CSO Sv. Djordje iz Nijagare

PRESUDA VELIKOG CRKVENOG SUDA


Vladika kanadski g.Georgije (Djokic) je aktom 159, od 5.aprila 2006. godine, zabranio bogosluzenja u
hramu Svetog velikomucenika Georgija na Nijagarinim vodopadima, Ontario, Kanada.

Ova zabrana je trajalo 4 punih godina, gde je veliki otpadnik Boziji zabranio sva krstenja, opela, vencanja,
ispovest i pricesce svim clanovima i parohijanima. (gledajte film “SVETA SMELOST” da cujete sta nardod
kaze I da vidite sami malverzacija ovog nedostojnog episkopa SPC). Angelina “Srpska”, reziser je snimila,
obelodanila, raskrinkala i izblicila arh-gresnika do besvesti da je jasno janku i marku i svakom srbinu i
nesrbinu.

Advokatska kancelarija koja zastupa Eparhiju poslala je tuzbu civilnom sudu protiv sest clanova uprave
CSO "Sveti Djordje": Dusana Kolundzica, Aleksandra Pantelica, Zivorada Jovanovica, Milene Dancuo,
Mihaila Savica i Sime Bijelica. Kao neosnovana, tuzba nikada nije pokrenuta i pred drzavnim vlastima
sudski proces je na taj nacin zavrsen. Uporedo sa tim, 27. marta 2006. godine, imena gorepomenutih
sestoro upravnika pojavila su se na spisku tuzenih crkvenom sudu Eparhije kanadske na kome je po
svojoj duznosti predsednik suda sam vladika Georgije. Obizrom na funkciju na kojoj se nalazi bilo je
nedopustivo da vladika tuzi upravnike iz Nijagare i da istovremeno predsedava crkvenim sudom.

U nemogucnosti da nastavi proces crkvenog suda vladika Georgije (Djokic) je 20. jula 2006. godine slucaj
poslao Velikom crkvenom sudu na razmatranje.

Odlukom donesenom 20. maja 2007, Veliki crkveni sud je predmet protiv odbornika CSO "Sveti Djordje"
poverio sudu Istocnoamericke eparhije kao neutralnom. Nakon godinu dana cekanja optuzeni su pozvani
da dodju na saslusanje koje je obavljeno 10. jula u prostorijama Eparhije istocnoamericke.
Vladika Georgije (Djokic) ni ranije nije postovao odluke visih crkvenih vlasti u sporu sa Nijagarom i
imajuci to u vidu optuzeni su se obratili direktno Patrijarsiji SPC u Beogradu u zelji da saznaju na kom
stepenu se nalazi njihov slucaj.

Pocetkom januara 2008. godine dobili su potvrdu da je Veliki crkveni sud zasedao i da je presuda
donesena, a da je vladika Georgije (Djokic) odgovoran da im presudu uruci.

Nakon mesec dana strpljivog cekanja, upravnici su bili slobodni i obratili se:

1) Gospodinu Iliji Rakanovicu, potpredsedniku Eparhije kanadske;


2) Protojereju stavroforu Lazaru Vukojevu, sekretaru Crkvenog suda Eparhije kanadske i zameniku
vladike Georgija;
3) Gospodinu Davoru Milicevicu, sekretaru Eparhije kanadske;

Sva trojica su imali identican odgovor koji je glasio da su razgovarali sa vladikom Georgijem i da nikakva
presuda nije stigla!

Isto je potvrdio i sam vladika Georgije, rekavsi:

"Proces se odvija na sledeci nacin: Prvo Veliki crkveni sud ce dostaviti nekome ili je dostavio, mene nije
obavestio, da verifikuje ono sto je Crkveni sud nas trazio, odnosno da udovolji vasem zahtevu o izuzetku
Crkvenog suda. Kada taj sud obavi posao on ce dostaviti nama na verifikaciju vasih izjava da li su tacne ili
nisu".

Upravnici su shvatili da od vladike Georgija (Djokica) presudu nikada nece dobiti, pa su se, izmedju
ostalih, obratili Velikom crkvenom sudu i Sinodu SPC. Zahvaljujuci Patrijarsiji SPC u Beogradu optuzeni
upravnici su presudu dobili 21. februara 2008. godine.

U presudi jasno stoji da su optuzeni upravnici oslobodjeni iskljucenja iz crkvene zajednice kojima ih je
vladika Georgije kaznio i da omoguci bogosluzenja u crkvi odmah po dobijanju presude. Duznost clanstva
u Nijagari je da svoja lokalna pravila uskladi sa Ustavom SPC u Kanadi i Americi.

Ni posle dva meseca od odluke suda vladika Georgije nije presudu urucio. Clanovi i parohijani iz Nijagare
tu presudu, kao i kaznu koju je ranije izrekao, ne dozivljavaju kao svoju licnu, jer nije kaznjeno samo
navedenih sest lica, nego je vladicinim aktom 159. kaznjena citava kolonija koja je time izopstena iz
crkvene zajednice.

Dostavljamo vam na uvid presudu Velikog crkvenog suda SPC kao najvise zakonodavne vlasti u nasoj
Crkvi.
