Re: Proposed ISC/Intel Agreement

Dear Chairman Dunlap:

The Pueblo of San Felipe joins others in requesting that the New Mexico Interstate
Stream Commission (ISC) postpone decision on the proposed agreement between the ISC
and Intel Corporation until the Pueblo has had a reasonable time to consider the complex
issues raised by the proposed agreement.

The agreement has potential for long-term and far-reaching impacts on the waters of the
Middle Rio Grande, upon which San Felipe has relied for countless generations. It raises
significant issues of law and policy. Despite negotiations between the ISC and Intel that
spanned a number of years, the Pueblo was informed of the agreement only a month ago.
One month is not sufficient time to understand or analyze the hydrologic, legal, and
policy implications of the proposal. We believe it is critical that the ISC decision-making
process provide adequate opportunity for public review and comment. We therefore urge
the ISC to postpone making any decision at its June 16, 2010 meeting.
