CERTIFICATE OF SUBSTANTIAL IMPAIRMENT TO PROCEED TO TRIAL

The People of the State of Illinois, by James Glasgow, State's Attorney of Will County,

Illinois, certify that, based upon the Court's ruling of June 18, 2010, suppressing as evidence certain

evidence offered both under a motion to admit prior bad acts and a motion to admit evidence under

725 ILCS 5/115-7.4, to wit: (1) testimony of Victoria Connelly; and (2) testimony of Eric Peterson

and Anna Doman, the People are unable to proceed to trial in this matter. See People v. Young 82

I11.2d 234, 247 (1980); Supreme Court Rule 604(a)(1). In support thereof, the People state the

following:

1. Defendant is charged with two counts of first degree murder.

2. On June 18, 2010, this Court entered an order suppressing as evidence certain evidence

offered under both a motion to admit prior bad acts and a motion to admit evidence under 725 ILCS

5/115-7.4, to wit: (1) testimony of Victoria Connelly; and (2) testimony of Eric Peterson and Anna

Doman.

3. The suppression order substantially impairs the state's ability to proceed with this case.

WHEREFORE, the People of the State of Illinois certify that they are unable to proceed to

trial in this matter and submit that this prosecution must be held in abeyance pending the disposition

of this appeal.
