DEED OF TENANCY AGREEMENT

THIS DEED OF TENANCY AGREEMENT is made on this day of _________


‘2022 at Guwahati.
- BETWEEN -
SMT. PANCHALI DAS BHATTACHARJEE, daughter of SRI PIJUSH RANJAN
DAS, resident of TYPE-III QTRS. ASEB COLONY, FOREST GATE, NARANGI,
Guwahati – 781026, in the district of Kamrup (Metro), Assam, for the purpose of this
present hereinafter referred to as the LANDLORD/ First Party (which expression
shall unless otherwise excluded by or repugnant to the context be deemed to mean
and include his respective heirs, executors, successors, attorneys, administrators
and assigns, legal representatives, any other person or persons claiming title under
his) of the one part.
- AND -
SRI SAILENDRA KARDONG, son of SONA RAM KARDONG, resident of QTR NO.
C 2019, SECTOR 2, NOONMATI, GUWAHATI REFINERY TOWNSHIP,
NOONMATI, DIST – KAMRUP(M), Guwahati - 781020, in the district of Kamrup
(Metro), Assam, for the purpose of this present hereinafter referred to as the
TENANT / Second party (which expression shall unless otherwise excluded by or
repugnant to the context be deemed to mean and include his respective heirs,
executors, successors, attorneys, administrators and assigns, legal representatives,
any other person or persons claiming title under his) of the other part.

WHEREAS the Landlord /First Party is the absolute owner having marketable
right, title, interest and possession in respect of a Flat bearing No. D2 in Block – A of
the “MARUTI RADIANCE ENCLAVE”, standing over a plot of land measuring 1Bigha
2 Kathas 6.5 Lechas (19.43Are) covered by Dag No.893/30 (old)/41(new), 895/35
(old)/42(new) of K.P. Patta No.37/155(old)/ 811 (new) of Village – Satgaon, Mouza-
Beltola, P.S. Satgaon, bearing G.M.C. Holding No. 11338320(New) of ward No.24
(New), situated on Satgaon Road, Patharquarry, opposite SFS School, Guwahati, in
the district of Kamrup, Assam which is morefully described in Schedule – “A” below.

AND WHEREAS on the request of the Tenant/ Second Party, the Landlord/
First Party has agreed to grant tenancy on monthly rental basis in respect of the
demised premises for a term of 11 (eleven) months commencing from the 15TH day
of APRIL’2022 at a monthly rent of Rs.16000.00 (Rupees Sixteen Thousand Only),
the rent whereof becoming due and payable on the first day of each calendar month
as per English Calendar on the following terms and conditions:

TERMS AND CONDITIONS:

1. The Tenant/ Second Party shall occupy the demised premises for the period
of 11 (eleven) months only commencing from the 15 th day of April, 2022.

2. At the time of commencement of this tenancy, the Tenant/ Second Party shall
pay to the Landlord/ First Party two months rent in advance, which amount would
be interest free and shall be refunded by the Landlord / First Party at the time of
vacating the tenanted premises by the Tenant/ Second Party.

3. The monthly rent of Rs.16000.00 (Sixteen Thousand Only) in respect of the


demised premises would be payable by the Tenant/ Second Party to the Landlord/
First Party by means of Account Payee Cheques/Internet Banking/Online
Transfer(NEFT/RTGS/IMPS etc.) relatable to each calendar month.

4. The Tenant/ Second Party has paid to the Landlord/ First Party a sum of
Rs.32,000/- (Rupees Thirty Two Thousand Only) being two months advance rent by
means of online money transfer / Internet Banking bearing Transaction
No._______________ Dated ___________ carried out on State Bank of
India Network the receipt whereof, the Landlord/ First Party hereby acknowledges.

5. The Tenant/ Second Party hereby agrees to pay the rent regularly as
aforesaid on the days and in the manner as mentioned aforesaid.

6. The Tenant/ Second Party agrees to pay the electricity bills on the basis of
actual consumption of electricity consumed for lighting the demised premises and for
operation of Air Conditioners, Fans, Computers and electrical gadgets and
appliances in the demised premises.

7. The Tenant/ Second Party shall not make any structural alterations into or
upon the demised premises or make any alterations or addition to the external
appearance or any part of the demised premises without the previous consent of the
Landlord/ First Party in writing.

8. The Tenant/ Second Party shall use the demised premises for residential
purposes only.

9. The Tenant/ Second Party shall not place or keep or permit to be placed or
kept on the demised premises any offensive, dangerous or highly inflammable or
explosive material or any other article or things, which may constitute a danger,
nuisance or annoyance to the demised or surrounding premises or the owners
thereof.

10. The Tenant/ Second Party shall not sub-let, transfer, assign or part with the
possession of the demised premises or any part thereof.

11. The Tenant/ Second Party shall permit the Landlord/ First Party, his servants,
employees or agents duly authorized by him to enter into and upon the demised
premises at all reasonable times for viewing the condition of the demised premises
or doing such works or things as may be requisite or necessary for any repairs,
alteration, servicing or improvements to the demised premises.

12. This Tenancy agreement shall be valid for a period of 11 (eleven) months
from the date of its commencement which would, however, be open to renewal for
further period on mutually agreeable terms and also subject to enhancement of
monthly rent at the rate 20% (Twenty Percent) on the existing rent .

13. That on the date of expiry of the tenancy or otherwise in the event of
termination of the agreement, the Tenant/ Second Party would handover the vacant
possession of the demised premises to the Landlord/ First Party by removing his
men and materials therefrom.

14. That the tenancy would be terminated at the option of the either party by
serving TWO MONTHS prior notice in writing by either of the parties.

15. The minor repairing, white washing or painting of the demised premises would
be carried out by the Tenant/ Second Party at his own expenses.

16. The Tenant/ Second Party shall not obstruct or suffer to be obstructed the
entrances, doorways, passages, staircase or lifts etc.

17. The Tenant/ Second Party would pay the maintenance charges, security
charges and other utility charges payable to the Society of the apartments as per
actuals. Such utility and / or society maintenance charges will be paid by the
Tenant / Second Party directly to the authorized person of the society by means of
Account payee cheques or by Online transfer of money e.g.; IMPS/NEFT on month
to month basis for each calendar month failing which the Tenant/ Second Party shall
become a defaulter.

18. As per Clause 16 hereinabove, the Society Charges would be payable for
each month on the first day of commencement of the calendar month.

19. It is hereby agreed that if the rent or any part thereof payable in respect of the
demised premises shall be in arrear for a period of one month or if the Tenant/
Second Party shall omit to perform or observe any covenants or conditions on
his/her part herein contained, the Landlord/ First Party may re-enter upon the
demised premises after serving prior notice to the Tenant/ Second Party.
S C H E D U L E “A”
A Flat bearing No. D2 in Block – A of the “MARUTI RADIANCE ENCLAVE”,
standing over a plot of land measuring 1 Bigha 2 Kathas 6.5 Lechas (19.43Are)
covered by Dag No.893/30 (old)/41(new), 895/35 (old)/42(new) of Patta
No.37/155(old)/ 811 (new) of Village – Satgaon, Mouza- Beltola, P.S. Satgaon,
bearing G.M.C. Holding No.11338320(New) of ward No.24(New), situated on
Satgaon Road, Patharquarry, opposite SFS School, Guwahati, in the district of
Kamrup, Assam Guwahati, in the district of Kamrup, Assam.

IN WITNESSES WHEREOF both the parties put their hands unto this Deed of
Tenancy Agreement with their free will and consent and in sound health and mind in
the presence of the following witnesses on the day, month and year written above.
