DEED OF TENANCY AGREEMENT

THIS DEED OF TENANCY AGREEMENT is made on this day of , 2021 at


Guwahati w.e.f. 19.02.2021;
-BETWEEN-
MRS. ANIMA BARMAN, W/o- Mr. Dinesh Ch. Barman, permanent resident of
H./No.-14A, Santinagarpath Path, Mother Teresa Road, Near Hindi School, P.O.-
Noonmati, P.S.- Noonmati in the district of Kamrup (Metro), Assam, Pin No.-781020
hereinafter called the “LANDLADY/FIRST PARTY” (which expression shall unless
and otherwise repugnant to the context and meaning and herein shall include her
executors, successors, attorneys, heirs and assigns etc.) of the ONE PART.

-AND-
MR. ISWAR PRASANNA KONCH, S/o Thaneswar Konch, Permanent resident of
Vill/Town- Bhortal Chuk Gaon, P.S.- Dhakuakhana, P.O.-Dhakuakhana in the district
of Lakhimpur, Assam, Pin No.-787055 hereinafter called the 'TENANT'/
SECOND PARTY (which expression shall unless and otherwise contrary or
repugnant to the context and meaning made herein, include their heirs,
successors, assignees and representatives) of the SECOND PART;

WHEREAS, the Landlady is the absolute owner and possessor of the R.C.C building standing
over the plot of land covered by Dag No.651 and Patta no.264 situated at 2 No Mathgharia,
Mother Teresa Road, Santinagarpath, H./No.14A, Mouza-Beltola in the district of Kamrup (M),
Assam-781020.
-AND-
WHEREAS the Landlady on request of the Tenant has decided to let out one part out of two
parts of the 1st floor of the aforesaid R.C.C. building from the date of execution of the present
deed of tenancy agreement for residential purposes only on monthly rental basis. The letting-
out part is consisting of 2 (two) rooms along with 1 kitchen, 1 (one) latrin-bathroom and 1
balcony. The letting out each room is a part under this present agreement and this agreement is
for a period of another 11 (eleven) months from today under the following terms and
conditions.

NOW THIS DEED WITNESSETH AND IT IS HEREBY AGREED TO BY THE


PARTIES AS FOLLOWS:

1. That the tenancy shall be effective from 19th day of February, 2021 and shall be
enforce on for a period of 11 (Eleven) months only.

2. That the present deed of tenancy agreement is executed for a period of 11 months from
the date of execution of this agreement. Further, after expiry of the stipulation period, the
instant agreement shall stand automatically terminated. However, after expiry of the tenancy
period if the Landlady thinks to extend the tenancy period with the present tenant, she is at
liberty to extend the tenancy period by executing a fresh tenancy agreement with a fresh
tenancy rate.

3. That the tenancy shall be on monthly rental basis at the rate of Rs.8,000/- (Rupees
Eight Thousand only), being the amount of rent which shall have to be paid within the 5th Day
of every English calendar month either by cash or though online bank. Apart from the monthly
rent as mentioned, the TENANT shall be liable to make payment of an amount of Rs.8,000/-
(Rupees Eight thousand only) as advance rent.

4. That the Tenant shall pay electricity charges separately to the Landlady @ Rs. 9/-per
unit of the sub-meter.

5. That in case of default of rent for consecutive two months then the Landlady has the
liberty to rescind this agreement and the Landlady has the right to recover the rent and other
dues after following due process of law.

6. That the tenant shall use the scheduled tenanted premises exclusively for residential
purposes only.

7. That the Tenant shall not keep or store any objectionable materials like explosives or
explosive substances and chemicals in the course of his stay nor shall be carry on any business
in contravention of any existing laws of the State or Central Government.

8. That the tenant is not at all entitled to make any alterations in the said premises. Any
damage causes to the premises by the tenant must be repaired at his own cost and
responsibilities.

9. That it is also stated that spitting on the walls (inside & outside of room), in the corner
of the building and anywhere inside the campus due to chewing tobacco, paan is strictly
prohibited and for that the tenant must keep his spittoons to maintain cleanliness of the
premises. If any dirt causes to the building/properties by the tenant must be repaired at his own
cost and responsibilities.

10. That the tenant shall keep the tenanted premises in good condition and order and
handover it in the same condition as it was at the time of handover.

11. That the landlord is at liberty to inspect the tenanted premises at any reasonable time as
the landlady deem fit and proper.

12. That the tenants shall not cause any nuisance in and around the campus of the tenanted
premises and in case if any complaint receives by the neighbours about the tenant, the landlady
is bound to give notice to the tenant to vacate the premises within a period of 30 days.

13. That That both of the parties shall have to give one (1) month advance notice in writing to
each other in case of vacating the premises in question before the expiry period of the tenancy.

14. That upon termination of this deed, the tenant will remove all fixtures, fitting, equipments
etc and all its belongings from the said premises without causing any damage to the said
premises.

15. That in the event of any dispute, or difference of opinion arise, then the same shall be
settled by the Court of Competent Jurisdiction. In this case it will be the courts of Guwahati.

RESPECTIVE HANDS ON THE DAY, MONTH AND YEAR FIRST HEREINABOVE
WRITTEN.
