Sir, 

Under the instructions from and on behalf of my client M/s

Franciscan Solutions Pvt. Ltd. having its registered office at A-242,

G.F Defence Colony New Delhi-110024, I hereby serve upon you

with the following Legal Notice:-

1. That as you the noticees are aware that my client M/s

Franciscan Solutions Pvt. Ltd. is one of the leading companies

in Web Technologies and software development providing

cutting edge solutions to its customers/clients, the company is

specialized in developing and application of software which are

mostly used by leading schools and education centres all

across India.

2. That my client has developed and is the owner of Franciscan

e-Care which is an offline-online synchronized ERP and e-

communication system, which is a grand success and which

became the most popular tool for various schools and other

educational institutes, this software provides the much needed

 link in the communication gap existing between the parents

and the teachers by giving 24x7 SMS facility, voice sms and

many other unique features which enables open and

transparent interaction between the parents, teachers,

principal, and management thereby giving them the much

needed support for the growth and development of the

children.

3. That my client is providing the aforesaid facilities to the

different school etc. and has engage you the noticee for

installation of one 55 Inch Kiosk at CSDS Global Academy,

Lucknow.

4. That you the noticee had assured my client that the said 55

Inch Kiosk at CSDS Global Academy, Lucknow would be

delivered and installed till 12.02.2019 and as per you

assurance my client had given you a sum of Rs. 1,11,392/- as

decided between you the notice and my client.

5. That after receiving the sum of Rs. 1,11,392/- from my client,

you the noticee many times jump the time line given by you,

and thereafter you started giving my client vague assurance of

installation of said kiosk at CSDS Global Academy, Lucknow.

6. That my client many times requested you for such installation

of kiosk at CSDS Global Academy, Lucknow but you the

noticee did not installed the kiosk.

7. That now you the noticee has clearly denied my client for

installing the said kiosk at CSDS Global Academy, Lucknow

 and has also denied to return the amount of Rs. 1,11,392/- to

my client, thereby causing wrongful loss to my client.

8. That as you the noticee has not installed the said kiosk on

time, the reputation of my client in front CSDS Global

Academy, Lucknow has been diminished and they are

searching for an alternate of my client.

9. That in such way you the noticee has committed an offence of

cheating and criminal breach of trust punishable u/s 420/406

of Indian Penal Code, further my client is also entitled to

recover the aforesaid amount duped by you the noticee.

I therefore, call upon you the noticees through this Legal

Notice to:-

a. to installed the kiosk at CSDS Global Academy, Lucknow

within 3 days for the receipt of this legal notice.

Or

b. to return the amount of Rs. 1,11,392/- along with

interest of @ 24% p.a.

c. to pay a sum of Rs. 2,00,000/- as the compensation for

diminishing the reputation of my client.

Kindly note that in the event you fail to comply with the

present notice, I have clear instructions to take legal recourse

for the same against you in the Competent Courts of Law,

including criminal and civil proceedings entirely at your costs,

risks & responsibilities, which please note.

This legal notice runs along 1 to 4 pages and each page bears

my signature.
