DearSir,
Under instruction and on behalf Ms. KhushbooSehgal R/o E-355, Gali No. 6,West Vinod
Nagar, Mandawali, East Delhi, Delhi-110092 (hereinafter referred toas “My Client”), I
serve upon you the present Legal Notice under reference,
withthefollowingeffectsasmentionedhereunder:-
1. That, My Client was appointed by the Company vide offer letter bearing
no.Ref:VHBO/PROC/MC/KS/2020-2021dated20thNovember2020asaReginal
Business Manager-(Procare Division) and the salary of My
ClientwasfixedatRs.5,10,000/-(FiveLakhTenThousandrupeesonly)annually.My
client joined the work place with effect from 1stNovember,2020 vide your letter my
client joined the office vide your appointment letterdated27thNovember,2020.
2. My client joined the office as per terms and conditions of the offer letter
andtriedhislabelbesttoensurethebetterinterestandgrowthofthecompany.
3. That My Client did his duty diligently, regularly and with utmost punctualityand
sincerity and with full devotion bydoing job with his own hands inaccordance with
the well-settled provisions of the law. You issued the offerletter in the name of My
Client and got printed the visiting cards also in thename of My Client along with the
Identity Card bearing Employee code no.13741.In furtherance to objective and good
interest of the Company
MyClientputhisbesttoachievetargetsandsucceededtoamaximumextent.
4. As per termsof the Service a probation period of one year wasto
becompletedwhichwassubjecttothepaymentofagreedsalary.However,prior to
competition of probation period of one year at the fag endwithout assigning any
cogent reason in furtherance to a hatched conspiracyMy Client was transferred from
the post toCYTOCARE DIVISION witheffect from 2ndJune, 2021 without
consulting and taking consent from
myclientunderthepretextofBusinessexigenciesvideletterno.REF.NO.TRANSFER/PR
OCARE/HR/SPM/KS/2021-2022 dated 19thJune, 2021,without any extras
remuneration and other benefits. It is blatant violation ofterms and conditions of
contract between your company and my client. Hewas supposed to be at the same
place till his probation period of one yearbut he was transferred to other division
without justifying any reasonablegrounds.
5. The unjustified transfer of my client to the other division for which he wasgiven
offer letter and specific training is clear violation of your terms
andconditionagainstnaturaljustice.
6. This unjust behavior has caused tremendous pressure in mind of my client.He was
not given opportunity to be heard and she had no option other thansubmitting his
resignation. Although she has not submitted her resignationunder protest but in a
casual manner. She has submitted her resignation on07 thAugust,2021. Although she
has left prior to notice period as per termsand condition of contract but the reason
must be taken into consideration ofdenying her full and final settlement by way of
causing her financial loss. Inthe same bridge, My Client was again assured to make
full & final settlement at the earliest by the concerned persons of HR department
without deducting unjustified reasons e.g. training etc. How ever as till date the
company has utterly failed in settling the outstanding salary and F& F and tothe
contrary, the concerned persons / staff of the Company are not even at tending and
responding the calls of My Client.
7. For your kind attention, it is to bring to your notice that because of thedecision of
few Officials just soon after the Lockdown, My Client is suffering financial
hardship by You Noticee, which has left My Client to suffer various financial
constraints and many more uncalled for and un-warranted financial problems in life.
8. In the prevailing circumstances, being left with noother option, My Client has
imparted me with the instructions to take appropriate legal resource asagainst You
Noticee and the director of the Company. It is further clarifiedthat You Noticee
being the MD. of the Company directly involved in day today affairs and are
responsible for non-payment of the due salary of My Client and would be further
responsible for all the cost and consequences.
9. That my client also inform you through mail as attached with the same legal
notice regarding full and final settlement for which you the above said
adressee even not reverting on the mail which crystal clear the situation that
you have misappropriated my client.
10.In view of the same, besides your civil and contractual liabilities towards My Client,
you Noticee and other concerned persons are also liable to be criminally prosecuted
for the offence of cheating and fraud punishable underthe provisions of Section 406
of the Indian Penal Code and for the offenceof criminal conspiracy under the
provisions of Section 120-B of the IndianPenal Code. My Client reserves rights to
initiate appropriate criminal action against you in this regard as and when required.

Now there fore, I put you Noticee and call upon to do the following acts within seven

(15) days of the receipt of this notice:-

ainstInstitute,YouNoticeeand

concerned Director, in the Competent Court of Law and in that event, youshall be

held liable for all the costs and consequences arising out of suchuncalled-

forandavoidablelitigation.

A copy of this Legal Notice is kept in my office for record and further necessaryaction
and you are also advised to keep the copy safe as you would be asked
toproduceinthecourtifsorequired.
