LEASE DEED

This lease deed is made at Chandigarh on this __________ day

of ___________2006, between:-

1. Surinder Kumar s/o Sh. Ram Sarup Kathuria R/o #922, Sector 9,

Panchkula (hereinafter referred to as the landlord) of the one part of this rent

agreement.

AND

2. Sh. Prem Chand Sharma s/o Sh. Shivram Sharma R/o #467,

Nagad Nagar, Tehsil Sunder Ban, District Rajouri, Jammu & Kashmir-185155

presently residing at House No.1087, Sector 19-B, Chandigarh (hereinafter

referred to as the tenant) of the other part of this rent agreement.

Whereas the above said landlord is the absolute owner of SCF 25,

Sector 26, Grain Market, Chandigarh and the above tenanted had contacted

the landlord to take on rent room/office (which measures 15 ft. 6 inches x 8 ft

inches) on 2nd Floor of the above mentioned SCF, excluding small room

attached to the room cum office above mentioned (within the premises) of

SCF 25, Sector 26, Chandigarh for office use.

Whereas landlord has agreed to rent out the said premises to the

said tenant on the following terms and conditions:-

1. That the present lease is on month-to-month basis commencing

with effect from 01st April 2006.

2. That the rate of rent of the tenanted premises is settled at the

rate of Rs.25,000/- (Rupees Twenty Five Thousand Only) including water and

electricity charges.

3. That the telephone charges would be paid separately by the

tenant for the Phone No.0172-2793004, provided by the landlord to the

tenant.

4. That one small room/store attached with the above said room is

in possession of the landlord and landlord can use that room/store by getting

passage from the tenanted room and tenant will not object or create any

hindrance in the passage from the room.

5. That the rent is payable in advance by 7 th of each British

Calendar Month.

6. That the rent will be increased by the tenant at the rate of 10%

(Ten per cent) of the previous rent on expiry of every eleven months.

7. That the tenanted premises shall be used by the tenant

exclusively for residential purpose only.

8. That the tenant will not make any structural addition or alteration

in the tenanted premises.

9. That the tenant shall not sublet or part with the tenanted

premises and shall use the premises for residential purpose only.

10. That the tenant will not store any unlawful/inflammable articles

goods in the tenanted premises.

11. That the tenant shall be responsible for the damages if any done

to the tenanted premises i.e. electrical, sanitary fittings and window panes

flooring etc.

12. That the landlord shall have the right to visit the tenanted

premises in question for inspecting the conditions during the day hours.

13. That all the taxes i.e. property tax, sewerage tax/charges and

other taxes/fees which may be levied by the Government or concerned

authority or Municipal Corporation, U.T, Chandigarh in respect of the tenanted

premises from time to time shall be paid by the tenant.

14. That the tenant shall abide by the rules and regulations of the

Municipal Corporation, U.T, Chandigarh and of the Chandigarh Administration

and will not violate the Building Bye Laws.

15. That the tenancy is terminable by giving one month’s advance

notice from either side in writing addressed at the tenanted premises.

16. That in case tenant fails to abide by the terms and conditions of

this agreement then electricity to the second floor shall be disconnected and

tenant cannot object to it nor he can get/apply for new electricity connection

without written permission of the landlord.

17. That in case tenant fails to abide by the terms and conditions of

this lease deed then his tenancy shall be terminated automatically with

immediate effect without issuing any notice to the tenant.

18. That on termination of tenancy the tenant shall handover the

vacant peaceful possession of the tenanted premises with all the fixtures and

fittings in tact to the landlord.

19. That in case tenancy of the tenant terminated as per terms and

conditions of this lease deed then his possession in the tenanted premises

shall be deemed to be unauthorized and he shall have to pay damages for the

illegal use and occupation of the tenanted premises at the rate of Rs.50,000/-

(Rupees Fifty Thousand only) per month including water and electricity

charges, taxes till the date of handing over the vacant physical possession of

the tenanted premises, besides ejectment through court of law.

IN WITNESS WHEREOF both the parties have set their hands on

this lease deed at Chandigarh on the day, month and year first written above

in the presence of the witnesses.
