MD 21202 Re: Open Meetings Act Complaint - Montgomery County Public Schools To whom it may concern ‘The following Complaint is filed with your office with regard to meeting procedures of the Montgomery County Public Schools Board of Education, 1. On March 3, 2011, a memorandum was released by the Superintendent of Montgomery County Public Schools (MCPS} that detailed an Agenda item for the March 8, 2011, Board of Education meeting. (Exhibit A- Agenda Item 4.2.5) The Agenda item deais with the lease of a 20 acre property owned by the Board of Education. The memorandum included the following statement from the Superintendent, “Staff in the Department of Facilities Management briefed the Board of Education m May and June of 2010..." 2 A review of Board of Education meeting minutes from May and Sune of 2010, does not reveal an agenda item related to a lease for the Brickyard Road Middle School property. 3. Agenda Item 4.2.5 is scheduled for final action on March 8, 2011 ‘Thank you for reviewing these matters that directly impact the public's ability to monitor the actions of our elected Board of Education. Weast, Superintendent of Schools Subject: Lease Agreement Brickyard Road Site In November 2009, County Executive Isiah Leggett wrote to then Board of Education president, Mrs, Patricia B. O'Neill about leasing the Brickyard Road Middle School site for development of balifields. ‘Staff in the Department of Facilities Management briefed the Board of Education in May and June of 2010, after meeting with county staff to obtain more information about the proposal Staff in the Deparment of Facilities Management continued to work with representatives. of Montgomery County on the terms and conditions of a lease agreement. The county intends to build and operate athletic fields at the site through @ public/private partnership with an athletic organization. 1 am recommending that the Board of Education authorize the president of the Board and the superintendent of schools to execute a Land Lease Agreement with Montgomery County, which has been reviewed by the Board of Education's attorney. WHEREAS, Montgomery County is interested in constructing more ballfields to provide additional recreational facilities for Montgomery County residents and has identified the furure Brickyard Middle Schoo! site, located on Brickyard Road in Potomac, Maryland, as a location for ballfield construction; and WHEREAS, Montgomery County hus requested a land lease of the 20-aere ste that would include a term of 10 years with the option to reclaim the site should it be needed for school construction purpases; and WHEREAS, Montgomery County will be responsible for notifying the community, obtaining, al required permits, developing and maintaining the ballfields, and paying an annual rent of $1,500; now therefore be it Resolved, That the president of the Board of Felucation and the superinendent of schools be authorized to execute a Land Lease Agreement with Montgomery County for construction of ballficids at the furure Brickyard Middle Schoo! site, IDW:LABIS;jle
