Cindy's request that Eric not be allowed to sleep with Damon was denied by Judge Smyth, even though Damon was seven years old and distressed by it, and there had been lengthy litigation as to whether he was molesting Damon.
The first weekend after the 1/22/04 hearing where Judge Smyth had given more visitation to Eric (three weekends a month and during the week as well), Damon was very distressed because his father was still making him sleep with him. Cindy was afraid to bring it up because she had been warned not to mention the abuse again or she would lose custody. So she called the therapist. Damon's brothers knew Damon Had slept with Eric so he couldn't deny it. Damon later said that Eric began to wait until the brothers went to sleep before taking Damon out of his bed and bringing him upstairs to Eric's room. The therapist, Jacqueline Gang, simply said that he was using Damon to meet his emotional needs. She could have asked the judge to stop it, but she didn't. This is the same hand-picked therapist (a friend of Dr. Murphy's) who refused to talk to Damon about the abuse. She could have helped, but instead went along with the cover up. She was the only therapist allowed to see the boys.
This is a critical way that the court accomplishes the cover up: only professionals who are known to go along with the cover up are allowed on the case.
