FORMULAS FOR PARTY LIST ACCORDING TO BANAT v COMELEC

I. DETERMINING 20% (same as in Veterans)

EXAMPLE: The total number of district representatives is 220. (220/0.80) x 0.20 = 55 party list representatives

II. COMPUTATION OF SEATS ALLOTMENT

1. Rank parties. Determine Ratio for each party. Parties with a percentage of 2% and above have (1) guaranteed seat.

2. Determine number of remaining seats. (BANAT v COMELEC reversed computation in Veterans and allowed filling up of party list representatives up to the 20% threshold)

3. In allocating remaining seats to party lists, include non-qualifiers of guaranteed seats until all the remaining seats are consumed. Start with the parties who qualified and proceed to the parties next in rank. (Some parties may not have qualified for 2% threshold but acquires a seat from those remaining.)

1. Rank all participating parties, organizations and coalitions from the highest to the lowest based on the number of votes received. Determine Ratio for each party. Determine those with 2% and above.

EXAMPLE: DARNA Party list, DYESEBEL Party list and VOLTA Party list were some of the party lists which participated in the 2100 elections. DARNA Party list garnered the highest number of votes with 200, 000 votes, DYESEBEL Party List garnered 15, 000 votes while VOLTA Party list garnered 10, 000 votes. There were 710, 000 votes for the party list system all in all.

Volta will not have a congressional seat.

2. Determine the number of seats the first party is entitled to. A party receiving at least 2% of total votes is entitled to one seat. a. If 6% and above, exactly 3 seats are allotted (3 is the benchmark - the maximum number of additional seats allowed is 2) b. No rounding off

EXAMPLE: DARNA Party list is the first party with 200, 000 votes.

Alloted seats for DARNA = 3 (because greater than 6%)

3. Solve for the number of additional seats that the other qualified parties are entitled to based on proportional representation. *Only party lists with ratio greater than 2% are computed.

OR

EXAMPLE: DARNA Party list is the first party with 200, 000 votes. DYESEBEL Party list has 15, 000 votes. KRYSTALA has 150, 000 votes. There were 710, 000 votes for the party list system all in all.
