Respectable Sir

With due honour I would like to draw your attention on the above case No. filed by my elder brother Mr. Md. Yunus. Because of financial constraints, my brother Mr. Md. Yunus could not build a suitable house for living with his family for a long time. Realizing my brothers problem, I built a pakka house with 3 storey foundation at my own cost where he along with his family are living. The disputed land is my own land given by my father which I used as passage between my building Yakub Mansion and my rental semi pakka colony. Recently I have sold out the entire land by demolishing the colony. My brother Mr. Md. Yunus did not have a safety tank for his bathroom and latrine. He was using my safety tank which I made for my colony. The buyer built boundary wall and separated his purchased land and as a result my brother Mr. Md. Yunus and his family were in a problem due to lack of sewerage. In fact, after selling the land, I made up my mind to give that small land of my passage to my brother so that he can make a septic tank, latrine, etc to get rid of his problem. Accordingly, I made an offer to him, but all of a sudden he along with his sons, whom throughout my life I have helped in their needs, started non-cooperation with me. The result is the recent miscase filed against me. If you sir kindly review the will of my father, wherein he distributed his property to his heirs, you would find that my father gave me the disputed land of passage which he clearly mentioned in his property distribution will, and subsequent amendment of it. It is perhaps due to lack of proper education, poverty and old age, that my brother Mr. Md. Yunus did not realize my good intention and rather was inspired by his sons to file the case against me. This is very unfortunate and it is my ill luck that I got this behaviour from my brother, although I have been helping throughout their life in times of need. But Sir, he is my own brother and blood relation and I strongly feel that he needs a septic tank for sewerage. Therefore my submission to your honour is that I will not contest the case. This is for your kind consideration.
