COMPLAINT AFFIDAVIT
WHEREFORE, I Miguel Lopez de Legazpi, Filipino, of legal age, and residing at No. 642 Brgy. Pandaka Pigmea, Godonghea, Palo City do hereby depose that: 1. On the eve of July 24, 2010 on or about 8 oclock in the evening as I was on my way home, I was willingly, and maliciously stabbed by one Fernando Baltazar y Balagtas also Filipino, of legal age, and a resident of No. 242-B Quezon Apartments, Godonghea, Palo City; 2. Due to the incident I received one stab wound to my lower back a few inches from my liver. An injury which would have been fatal if not for the kind hearts of some passers-by who helped me receive timely medical aid; 3. Prior to the aforementioned assault, I and Mr. Baltazar had a misunderstanding in our place of work regarding a pilfering incident involving Mr. Baltazar, and which I discovered. Said incident would eventually result in the termination of Mr. Baltazar, and may be the root cause of the assault as he might be blaming me for his termination, though said circumstance was caused by none other than himself; 4. Due to the injury I received I was not able to attend to my industry resulting to economic prejudice to me and my family who is now shouldering the very expensive medical cost of my recovery; 5. In view of the foregoing I am constrained to file a criminal case for Frustrated Murder with the Branch VI of the Regional Trial Court of Tacloban so that justice may be brought to me and for Mr. Baltazar to reap the fruits of his wrongdoing.
