USUFRUCT AGREEMENT

This AGREEMENT is entered into by and between:

_________________________, of legal age, Filipino, _________________, and resident of


Brgy. ___________________, herein referred to as the LANDOWNER;

-and-
___________________________, who is of legal age, Filipino, ____________________ and
a resident of Brgy. ________________________ herein referred to as the BENEFICIARY;

WHEREAS, the LANDOWNER is the absolute owner of a parcel of land situated in


Brgy. ________________________, more particularly described as follows:

A parcel of land (_______________) of the Cadastral Survey of


___________________ with all the improvements thereon situated
in ___________________________. Bounded to the N. by
_____________________, on the E. by __________________________;
on the S. by ___________________; and on the W by
______________________. Containing an area of
________________________________________ (____________) square
meters more or less in the name of Cornelio Montejo.

WHEREAS, herein BENEFICIARY recognizes the full and absolute ownership of


the LANDOWNER of the herein subject property;

WHEREAS, herein LANDOWNER recognizes the need of the BENEFICIARY;

NOW THEREFORE, the LANDOWNER, out of her pure liberality and


generosity, hereby allow the BENEFICIARY and its members to use and occupy
THREE HUNDRED (300) sq. meters, free of any rent, fees or charges, subject to the
following terms and conditions:

1. LIMITATIONS ON THE RIGHTS & OBLIGATIONS OF THE PARTIES :

a. Maintain respect to the LANDOWNERS, their family members and to the


neighborhood;

b. Refrain from causing conflict or trouble in the community;

c. In case the BENEFICIARY will gather any produce already present at the
time of their entry into the property or otherwise belongs to the landowner or
may be taken from the land or other similar activities, the BENEFICIARY shall
ask permission from the LANDOWNER;

d. The BENEFICIARY shall in no case alienate, mortgage or lease out the


property or any portion thereof to any party;

e. The BENEFICIARY shall maintain the upkeep and preservation of the
premises, taking as much care of the property as a good father of a family
would take of his own property;

f. The BENEFICIARY must secure any farm animals within the premises of
the lot he is allowed to use or occupy (by tying or keeping them in cages) to
prevent them from causing damage to the other plants/trees or produce within
the premises;

h. The BENEFICIARY shall not construct concrete structures or improvement


on the building without the express consent of the Landowners;

i. The BENEFICIARY may not, at any instance, cut, burn or otherwise uproot
any and all trees, plants or crops existing at the time of the signing of this
agreement and those which may thereafter be planted by him and his
immediate members of the family during the subsistence of this agreement;

k. The LANDOWNER warrants the peaceful and adequate enjoyment of the


BENEFICIARY of the above-mentioned portion of the lot;

l. The LANDOWNER represents and warrant that she has a good, valid and
subsisting rights and interests and title to the aforementioned property;

m. That the LANDOWNER undertakes to defend the title to the above described
property against any and all claims of third person in any case, and to defend
the possession of the BENEFICIARY against all action for eviction. Beneficiary,
in turn, has the obligation to notify immediately the Landowners of any
intrusion or trespassing on the above-described lot.

2. TERM OF AGREEMENT /VIOLATIONS OF CONDITIONS:

This Usufruct Agreement shall valid for a period of two (2) years and may
be renewed only at the express consent of both parties.

3. BINDING EFFECT:

This agreement shall be binding upon the parties, their heirs, assigns
and successors-in-interest;

ACKNOWLEDGMENT

BEFORE ME, a Notary Public for and in the Province of Leyte, this
