Review of Regulations, Policies and Procedures Issued

Since August 2001

Purpose: The purpose of this review was to provide a synopsis of INS actions taken
over the past 16 months to enhance immigration services and strengthen enforcement
activities.

Methodology: The Office of Policy and Planning (HQOPP) reviewed and summarized
regulations, policy and procedural memoranda issued during that period focusing on
Service wide and program priorities with special emphasis on:

• International Students
• Inspection of Travelers at all Ports-of-Entry
• Adoptions
• Asylum Processing
• Child Status Protection
• Temporary Protected Status
• Legal Immigration and Family Equity Act
• Victim Trafficking and Violence Protection Act
• Unlawful Presence

Regulations reviewed were limited to those issued as interim final or final rules since
those were codified in title 8 of the Code of Federal Regulations and where no further
field guidance was issued.

Format: The following format was used to summarize and effectively inventory the
regulations, policies and procedures.

Subject: Identification of Program area and specific issues addressed.


Regulations, Policy or Procedure that was changed: Brief description of pre-
existing situation or circumstance.
Reason for the change: Brief explanation of the impetus for the change in
regulation, policy or procedure.
Regulation. Policy or Procedure Change: Description of the actual changes made
to existing regulations, policies or procedures or the establishment of new rules,
guidance or instructions.
