Mock Trial 2013-2014/Yonamine Final Semester Final Trial Case Scenario

On the night of September 2, 2013, Mr. Clair was driving with his girlfriend, Ms. Williams from their apartment in N. Portland to Javiers Taco Shop on N. Vancouver and N. Lombard. Mr. Clair made a sharp turn left from Ida onto Lombard, narrowly missing Ms. Theos car as she was trying to turn right from Ida onto Lombard. The sharp turn caused Mr. Clairs car to kick gravel towards Ms. Theos car. Ms. Theo blared on her horn as Mr. Clair raced past. After hearing the horn, Ms. Williams made a very obscene gesture to Ms. Theo. Mr. Clair didnt stop, but continued eastbound on Lombard at a speed over the limit. Ms. Theo followed Mr. Clair with both cars reaching speeds of almost 50 miles per hour. As Mr. Clair weaved in and out of traffic, Ms. Theo kept pace, honking her horn and flashing her high beams. As they approached N. Interstate, both cars accelerated and sped through a yellow light. Eventually, both cars screeched into Javiers parking lot at almost the same time. Ms. Williams got out of the car and took a baseball bat out of the trunk. Ms. Theo also got out of the car and walked over towards Mr. Clair, screaming profanities. While Ms. Theo was screaming at Mr. Clair, Ms. Williams ran over to Ms. Theos car and started bashing the windshield with the baseball bat. As soon as Ms. Theo heard Ms. Williams hitting her car, she turned her attention and ran towards Ms. Williams. First, Ms. Williams hit Ms. Theo with the bat in Ms. Theos left knee. The second swing hit Ms. Theo in the right knee sending Ms. Theo sprawling to the ground. After Ms. Theo fell to the ground, Ms. Williams hit her in the back once more with an overhand swing of the baseball bat. Officer Rudy arrived on the scene to find Ms. Theo on the ground near her car and Mr. Clair and Ms. Williams hugging each other on the curb. He first radioed 9-1-1 to get an ambulance for Ms. Theo. He then conducted interviews of Mr. Clair and Ms. Williams to get their versions of the events. He arrested Ms. Williams for assault and battery and placed her in the back of the police car. Officer Rudy walked around Ms. Theos car and surveyed the damage as she was placed into the ambulance and taken to Emanuel hospital. Officer Rudy then walked around Mr. Clairs car to inspect for damage. The car was undamaged and still running. The trunk appeared closed, but as he reached inside to turn the engine off, he noticed that the open trunk light was on. Officer Rudy walked around to the back of the car and opened the trunk, which was slightly ajar. He immediately smelled a strong odor of marijuana coming from the trunk. He shined his flashlight inside the trunk and found over 3 pounds of marijuana. The Prosecution represents the State and Ms. Theo. Your star witnesses are Ms. Theo and Ofc Rudy. The Defense represents Mr. Clair and Ms. Williams. They are your star witnesses.
