ANTI-GRAFT AND CORRUPT PRACTICES ACT

Sec. 1. Statement of policy. It is the policy of the hilippine
!o"e#nment$ in line %ith the p#inciple that a p&'lic office is a
p&'lic t#&st$ to #ep#ess ce#tain acts of p&'lic office#s an( p#i"ate
pe#sons ali)e %hich constit&te *#aft o# co##&pt p#actices o# %hich
may lea( the#eto.
Sec. +. ,efinition of te#ms. As &se( in this Act$ that te#m
-a./!o"e#nment/ incl&(es the national *o"e#nment$ the local
*o"e#nments$ the *o"e#nment0o%ne( an( *o"e#nment0cont#olle(
co#po#ations$ an( all othe# inst#&mentalities o# a*encies of the
Rep&'lic of the hilippines an( thei# '#anches.

an( employees$ pe#manent o# tempo#a#y$ %hethe# in the
classifie( o# &nclassifie( o# e1empt se#"ice #ecei"in*

Sec. 3. 3o##&pt p#actices of p&'lic office#s. In a((ition to acts
o# omissions of p&'lic office#s al#ea(y penali5e( 'y e1istin* la%$
the follo%in* shall constit&te co##&pt p#actices of any p&'lic
office# an( a#e he#e'y (ecla#e( to 'e &nla%f&l6
-a.e#s&a(in*$ in(&cin* o# infl&encin* anothe# p&'lic office# to
pe#fo#m an act constit&tin* a "iolation of #&les an( #e*&lations
(&ly p#om&l*ate( 'y competent a&tho#ity o# an offense in
connection %ith the official (&ties of the latte#$ o# allo%in*
himself to 'e pe#s&a(e($ in(&ce($ o# infl&ence( to commit s&ch
"iolation o# offense.
-'. ,i#ectly o# in(i#ectly #e7&estin* o# #ecei"in* any *ift$
p#esent$ sha#e$ pe#centa*e$ o# 'enefit$ fo# himself o# fo# any
othe# pe#son$ in connection %ith any cont#act o# t#ansaction

e"i(ent 'a( faith o# *#oss ine1c&sa'le ne*li*ence. This p#o"ision
shall apply to office#s an( employees of offices o# *o"e#nment
co#po#ations cha#*e( %ith the *#ant of licenses o# pe#mits o#
othe# concessions.

Sec. ;. #ohi'ition on p#i"ate in(i"i(&als. -a. It shall 'e
&nla%f&l fo# any pe#son ha"in* family o# close pe#sonal #elation
%ith any p&'lic official to capitali5e o# e1ploit o# ta)e a("anta*e
of s&ch family o# close pe#sonal #elation 'y (i#ectly o# in(i#ectly
#e7&estin* o# #ecei"in* any p#esent$ *ift o# mate#ial o# pec&nia#y
a("anta*e f#om any othe# pe#son ha"in* some '&siness$
t#ansaction$ application$ #e7&est o# cont#act %ith the
*o"e#nment$ in %hich s&ch p&'lic official has to inte#"ene.
Family #elation shall incl&(e the spo&se o# #elati"es 'y
consan*&inity o# affinity in the thi#( ci"il (e*#ee. The %o#(
/close pe#sonal #elation/ shall incl&(e close pe#sonal f#ien(ship$
social an( f#ate#nal connections$ an( p#ofessional employment
all *i"in* #ise to intimacy %hich ass&#es f#ee access to s&ch
p&'lic office#.

Sec. <. #ohi'ition on ce#tain #elati"es. It shall 'e &nla%f&l fo#
the spo&se o# fo# any #elati"e$ 'y consan*&inity o# affinity$
%ithin the thi#( ci"il (e*#ee$ of the #esi(ent of the hilippines$
the =ice0#esi(ent of the hilippines$ the #esi(ent of the
Senate$ o# the Spea)e# of the >o&se of Rep#esentati"es$ to
inte#"ene$ (i#ectly o# in(i#ectly$ in any '&siness$ t#ansaction$
cont#act o# application %ith the !o"e#nment6 #o"i(e($ That this
section shall not apply to any pe#son %ho$ p#io# to the
ass&mption of office of any of the a'o"e officials to %hom he is
#elate($ has 'een al#ea(y (ealin* %ith the !o"e#nment alon* the
same line of '&siness$ no# to any t#ansaction$ cont#act o#
application al#ea(y e1istin* o# pen(in* at the time of s&ch
ass&mption of p&'lic office$ no# to any application file( 'y him
the app#o"al of %hich is not (isc#etiona#y on the pa#t of the

pec&nia#y inte#est in any specific '&siness ente#p#ise %hich %ill

#esol&tion a&tho#e( 'y him p#e"io&sly app#o"e( o# a(opte( 'y

The p#o"ision of this section shall apply to any othe# p&'lic
office# %ho #ecommen(e( the initiation in 3on*#ess of the
enactment o# a(option of any la% o# #esol&tion$ an( ac7&i#es o#
#ecei"es any s&ch inte#est (&#in* his inc&m'ency.

Sec. A. Statement of assets an( lia'ilities. E"e#y p&'lic office#$
%ithin thi#ty (ays afte# the app#o"al of this Act o# afte# ass&min*
office$ an( %ithin the month of Ban&a#y of e"e#y othe# yea#
the#eafte#$ as %ell as &pon the e1pi#ation of his te#m of office$
o# &pon his #esi*nation o# sepa#ation f#om office$ shall p#epa#e
an( file %ith the office of the co##espon(in* ,epa#tment >ea($
o# in the case of a >ea( of ,epa#tment o# chief of an
in(epen(ent office$ %ith the Office of the #esi(ent$ o# in the
case of mem'e#s of the 3on*#ess an( the officials an( employees
the#eof$ %ith the Office of the Sec#eta#y of the co##espon(in*
>o&se$ a t#&e (etaile( an( s%o#n statement of assets an(
lia'ilities$ incl&(in* a statement of the amo&nts an( so&#ces of
his income$ the amo&nts of his pe#sonal an( family e1penses an(
the amo&nt of income ta1es pai( fo# the ne1t p#ece(in* calen(a#
yea#6 #o"i(e($ That p&'lic office#s ass&min* office less than t%o
months 'efo#e the en( of the calen(a# yea#$ may file thei#
statements in the follo%in* months of Ban&a#y.
Sec. C. ,ismissal (&e to &ne1plaine( %ealth. If in acco#(ance
%ith the p#o"isions of Rep&'lic Act 8&m'e#e( One tho&san(
th#ee h&n(#e( se"enty0nine$ a p&'lic official has 'een fo&n( to
ha"e ac7&i#e( (&#in* his inc&m'ency$ %hethe# in his name o# in
the name of othe# pe#sons$ an amo&nt of p#ope#ty an(Do# money
manifestly o&t of p#opo#tion to his sala#y an( to his othe# la%f&l
income$ that fact shall 'e a *#o&n( fo# (ismissal o# #emo"al.
#ope#ties in the name of the spo&se an( &nma##ie( chil(#en of
s&ch p&'lic official may 'e ta)en into consi(e#ation$ %hen thei#
ac7&isition th#o&*h le*itimate means cannot 'e satisfacto#ily
sho%n. Ean) (eposits shall 'e ta)en into consi(e#ation in the
enfo#cement of this section$ not%ithstan(in* any p#o"ision of la%
to the cont#a#y.
Sec. 9. enalties fo# "iolations. -a. Any p&'lic office# o# p#i"ate
pe#son committin* any of the &nla%f&l acts o# omissions
en&me#ate( in Sections 3$ ;$ < an( ? of this Act shall 'e p&nishe(
%ith imp#isonment fo# not less than one yea# no# mo#e than ten
yea#s$ pe#pet&al (is7&alification f#om p&'lic office$ an(
confiscation o# fo#feit&#e in fa"o# of the !o"e#nment of any
p#ohi'ite( inte#est an( &ne1plaine( %ealth manifestly o&t of
p#opo#tion to his sala#y an( othe# la%f&l income.
Any complainin* pa#ty at %hose complaint the c#iminal
p#osec&tion %as initiate( shall$ in case of con"iction of the
acc&se($ 'e entitle( to #eco"e# in the c#iminal action %ith
p#io#ity o"e# the fo#feit&#e in fa"o# of the !o"e#nment$ the
amo&nt of money o# the thin* he may ha"e *i"en to the acc&se($
o# the "al&e of s&ch thin*.
-'. Any p&'lic office# "iolation any of the p#o"isions of
Section A of this Act shall 'e p&nishe( 'y a fine of not less than
one h&n(#e( pesos no# mo#e than one tho&san( pesos$ o# 'y
imp#isonment not e1cee(in* one yea#$ o# 'y 'oth s&ch fine an(
imp#isonment$ at the (isc#etion of the 3o&#t.
The "iolation of sai( section p#o"en in a p#ope# a(minist#ati"e
p#ocee(in* shall 'e s&fficient ca&se fo# #emo"al o# (ismissal of a
p&'lic office#$ e"en if no c#iminal p#osec&tion is instit&te(
a*ainst him.
Sec. 10. 3ompetent co&#t. Until othe#%ise p#o"i(e( 'y la%$ all
p#osec&tions &n(e# this Act shall 'e %ithin the o#i*inal
4&#is(iction of the p#ope# 3o&#t of Fi#st Instance.
Sec. 11. #esc#iption of offenses. All offenses p&nisha'le &n(e#
this Act shall p#esc#i'e in ten yea#s.
Sec. 1+. Te#mination of office. 8o p&'lic office# shall 'e allo%e(
to #esi*n o# #eti#e pen(in* an in"esti*ation$ c#iminal o#
a(minist#ati"e$ o# pen(in* a p#osec&tion a*ainst him$ fo# any
offense &n(e# this Act o# &n(e# the p#o"isions of the Re"ise(
enal 3o(e on '#i'e#y.
Sec. 13. S&spension an( loss of 'enefits. Any p&'lic office#
a*ainst %hom any c#iminal p#osec&tion &n(e# a "ali( info#mation
&n(e# this Act o# &n(e# the p#o"isions of the Re"ise( enal 3o(e
on '#i'e#y is pen(in* in co&#t$ shall 'e s&spen(e( f#om office.
Sho&l( he 'e con"icte( 'y final 4&(*ment$ he shall lose all
#eti#ement o# *#at&ity 'enefits &n(e# any la%$ '&t if he is
ac7&itte($ he shall 'e entitle( to #einstatement an( to the
sala#ies an( 'enefits %hich he faile( to #ecei"e (&#in*
s&spension$ &nless in the meantime a(minist#ati"e p#ocee(in*s
ha"e 'een file( a*ainst him.
Sec. 1;. E1ception. Unsolicite( *ifts o# p#esents of small o#
insi*nificant "al&e offe#e( o# *i"en as a me#e o#(ina#y to)en of
*#atit&(e o# f#ien(ship acco#(in* to local c&stoms o# &sa*e$ shall
'e e1cepte( f#om the p#o"isions of this Act.
8othin* in this Act shall 'e inte#p#ete( to p#e4&(ice o# p#ohi'it
the p#actice of any p#ofession$ la%f&l t#a(e o# occ&pation 'y any
p#i"ate pe#son o# 'y any p&'lic office# %ho &n(e# the la% may
le*itimately p#actice his p#ofession$ t#a(e o# occ&pation$ (&#in*
his inc&m'ency$ e1cept %he#e the p#actice of s&ch p#ofession$
t#a(e o# occ&pation in"ol"es conspi#acy %ith any othe# pe#son o#
p&'lic official to commit any of the "iolations penali5e( in this
Act.
Sec. 1<. Sepa#a'ility cla&se. If any p#o"ision of this Act o# the
application of s&ch p#o"ision to any pe#son o# ci#c&mstances is
(ecla#e( in"ali($ the #emain(e# of the Act o# the application of
s&ch p#o"ision to othe# pe#sons o# ci#c&mstances shall not 'e
affecte( 'y s&ch (ecla#ation.
Sec. 1?. Effecti"ity. This Act shall ta)e effect on its app#o"al$
'&t fo# the p&#pose of (ete#minin* &ne1plaine( %ealth$ all
p#ope#ty ac7&i#e( 'y a p&'lic office# since he ass&me( office
shall 'e ta)en into consi(e#ation.
