Both the By Laws and the Meeting Resolution were violated at the March and April

Meetings.
I will be addressing these matters under Unfinished Business Item C.
I will submit details pertaining to 3 Governing Document Violations that relate to
the agenda.
I request that the minutes reflect my remarks.

The violations pertain to the following documents:
The meeting resolution includes, "The Chairperson for the Mesquite Vistas
Common-Interest Community will be the President." Then it specifically lists the
order for chairing meetings.

The Association Bylaws Section 9.8 include, The President shall preside at all
meetings of the board .

Additionally the meeting resolution includes, the Community Manager may make
recommendations at the request of board members upon recognition by the
chairperson.

Verifying these violations can occur by listening to the CD of the March 20, 2014
Board Meeting.
The CD will confirm that:
When the question was asked about why the President wasn't chairing the
meeting the response was we have a procedural reason for this. That is not an
answer or a reason to not comply and follow the Association By Laws and the
Mesquite Vistas Resolution.

Also the Community Manager is heard on the CD interrupting Owners and the
Chairman without requesting recognition or permission to speak. Another violation
of the governing document.

No response from the board table the following was again stated.

Speaker looked at Gordon Shepherd for answer. Gordon advised HO there was not going to
be any dialogue.
I close with the same Question heard on the CD from a Board Member, "If we have
rules and procedures, why don't we follow them?

I hope this matter has been presented in terms clear enough to the board that the
decision isn't to ask the attorney to review and reply we can't afford that.
