Release of an Easement
DEED OF RELEASE is made at ... this ... day of ... between Mr. A resid-
ing at ... hereinafter referred to as The Releasor of the One Part and Mr.
B residing at ... hereinafter referred to as The Releasee of the Other Part;
WHEREAS
1. The Releasee is the owner of an immoveable property consisting
of land situate at ... and more particularly described in the Schedule
hereunder written.
2. The Releasor has acquired a right of way over a part of the said
land by prescription.
3. The Releasee desiring to develop the said land has, therefore, re-
quested the Releasor to release the said land of his right of way over the
same which the Releasor has agreed to do on the Releasee paying him a
sum of Rs. ...
4. NOW THIS DEED WITNESSETH that pursuant to the said agree-
ment and in consideration of the sum of Rs. ... paid by the Releasee to
the Releasor (receipt of which sum the Releasor admits) he the Releasor
hereby releases and relinquishes all his right of way to pass or repass
over the land or any part thereof by night or day or at any time by foot
or by a vehicle or in any other way whatsoever to the intent that the said
land will be freed and discharged of the said easement by way of right of
way over the said land.
