4) OK Bar, an entertainment center hiring young, single and beautiful women
to cater to older gentlemen hired Carol. She reported for duty every night
and part of her duties were to dance clad in scanty clothing or sit beside a
male patron who would buy her alcoholic drinks for her consumption.
Carol was so competent that she would bring good business to the
establishment which caused her companions to envy her. One night,
Carol met a Japanese customer named Ichiro, who would be very nice to
her and made sure she would not only meet her quota but exceeded it
three times more. Ichiro would also bring her gifts every night to impress
her and in the hopes of winning her affection. Carol, sensing that he has
romantic intentions towards her avoided him for fear of being dismissed
and her companions reprisal against her but Ichiro was persistent. Carol
eventually fell in love with him and they got married. Upon learning this
fact, the management conspiring with her companions reassigned her to
be a janitor working during the morning because they alleged she was not
effective as a entertainer anymore. As janitor, she was paid at a much
lower compensation. Due to this she was ridiculed by her peers. She
resigned and brought this matter to the DOLE on account of discrimination
due to her marriage. The OK Bar Management countered that she was not
forced to resign or was dismissed even if there was a stipulation to that
effect in her employment contract. The act of reassigning her, according
to the respondent was a valid exercise of their management prerogative
and not an act of discrimination against married persons. Are they
correct? Why?

an accountant. One morning, while he was on his way to work, he was
side-swiped by a motorcycle which resulted in injuries. Can he claim
compensation even if he was not at the time of his accident?
